To the 35th and 36th articles hee saith and deposeth that hee beleeveth that<br />
the ''John and Conrard'' (belonging to the said Alderman ffrederick<br />
and others) did arive at Genua in or about January 1652<br />
English stile, and staid there about two monethes or more, and that<br />
if George Norliegh and company had or could have had the goods<br />
aforesaid (belonging to the said producents and<br />
then in the possession of the said George hughes or others by his<br />
appointment) they might have laden the greatest part thereof in the<br />
said shipp the ''John and Conrard''; which hee deposeth<br />
for that the said shipp the ''John and Conrard'' tooke in goods at freight<br />
for England that were sent from ligorne to Genua by severall<br />
marchants to be laden aboard her as by advise of letters (which hee hath seene) is evident, and yet through want of goods<br />
hee saith the ''John and Conrard'' came the greatest part emptie from thence, and afterwards arived<br />
safe at London with such goods as shee tooke in<br />
at Genua; And at last hee saith the said producents (through<br />
want of shipping to bring their goods from ligorne, were faine to send<br />
and did send a shipp purposely for them, which yet could bringe but<br />
part of them, not being capable to containe them all, And saith<br />
that noe part of those goods came or arived here at London till about<br />
July or August last past, of this deponents knowledge. And otherwise<br />
hee cannot depose.
To the 40th article hee saith and deposeth that the copie of the<br />
Pollicie of Assurance annexed and now showed unto him doth agree<br />
with the originall thereof subscribed by the Assurers therein<br />
mentioned, which hee knoweth, because hee this deponent on the 17th<br />
of November last compared the same with the policie<br />
Registred in the Assurance office, and subscribed his name testifying<br />
the truth of the said copie, as nowe appeareth, together with his<br />
contest John Chase. And saith that some of the Assuers<br />
have received their whole praemium's, and for the rest<br />
hee saith that some of them have received their<br />
halfe Praemium (they agreeing the voyage to and at Porto fferrara and<br />
both they and all other the assurers acquitted of any<br />
Adventure thence) and the rest are to receive their halfe Praemium<br />
accordingly, And saith the said Pollicie of Assurance is become<br />
of noe validitie in regard of the said masters deviation. And<br />
hee beleeveth that all the losse happened to the producents in the<br />
premisses, was occasioned by the said deviation. And otherwise hee<br />
cannot depose.
Upon the rest hee is not examined by direction of the producents protcor.
