this deponent and the arlate Anthony [?Bel … this deponent and the arlate Anthony [?Belvyn] arbitrators betwixt them<br />
touching all differences betweene the sayd Phillips and the parties in this suite<br />
And upon heareing the differences betwixt them it did appeare to this<br />
deponent and the sayd [?Belvyn] by the acknowledgment of<br />
the arlate Captaine hurley, John Searle and the sayd Bayley that they the<br />
sayd hurley and Searle had receaved of the arlate Captaine<br />
Phillips in money three hundred pounds and a bill for three hundred<br />
pounds more for the use of the sayd Captaine hurley and the sayd<br />
Bayly and the rest of the mariners of the ''Constant'' parties in this suite and<br />
in liew of their share of the prizes taken by them and that the sayd<br />
hurley Searle and bayley in behalfe of them selves and the rest of the<br />
parties in this suite did before this deponent and the sayd [?Belvyn] alsoe<br />
confesse and acknowledge that the sayd Captaine Phillips had paid<br />
divers other summes of money for the sayd Bayley and the parties in this<br />
suite which summes soe receaved of and paid by the sayd Phillips<br />
the sayd Hurley, Searle and Bayley in the behalfe of them selves and<br />
the rest of the Mariners of the ''Constant'' parties in this suite did<br />
allowe of, And hee further saith that upon full hearing of the sayd<br />
differences betwixt the sayd Phillips Hurley Searle Bayley and<br />
the rest of the parties in this suite it did plainely appeare to this<br />
deponent and the sayd Belvyn that the sayd Phillips had paid<br />
to the sayd hurley and Searle for the use of the sayd Bayley and other<br />
the Mariners of the ''Constant'' (parties in this suite) and in other summes<br />
of money paid by the sayd Phillips to other persons for their use<br />
and allowed of the sayd hurley Searle and Bayley more then what<br />
the shares of the parties in this suite in the prizes in question did<br />
amounte unto And further or more particulerly to these articles hee<br />
cannot depose these things being transacted longe since and the<br />
more particuler passages therein now out of his memory./
To the third hee hath heard that the Mariners of the<br />
''Constant'' parties in this suite did imbeazell and take out of the prizes<br />
in question divers goods and Merchandizes to a considerable value but<br />
to what some the things imbeazeled amounted to hee knoweth not And<br />
further hee cannot depose./
