examined.
To the first article hee saith that the time arlate the producent John<br />
Thompson and company were owners and proprietors of the shipp arlate<br />
called the ''small Mallaga Marchant'' and of her tackle, furniture and<br />
lading of salt arlate and other goods, and for such commonly accompted and<br />
reputed, which hee knoweth being one of her company namely cooper of<br />
her.
To the second article hee saith and deposeth that within the said time the said<br />
John Tompson being in the quiet possession of the said shipp and lading<br />
and sayling with the same betweene salt Turtudas and new-England<br />
was met with by a ffrench man of warr, which did rifle and pillage<br />
her of all her victualls and provisions which shee had for her companies subsistence<br />
the said voyage, leaving them in greate danger of perishing in the sea<br />
through want of victualls, which hee knoweth being one of her<br />
companie as aforesaid.
To the third, fourtha nd fifth articles hee deposeth and saith that being plundred<br />
and deprived as aforesaid of their provisions and victualls, soe that there<br />
was noe hope of subsistence at sea without present supplie, the said<br />
Tompson and company for the preservation of their lives were forced to put<br />
into hispaniola neare the harbour of Santo domingo with<br />
their shipp and lading, there to get victualls and water to keepe them<br />
from famishing, and hanging out a flagg of truce, there came an officer<br />
aboard from the Governour, to whom they declared their condition, and went<br />
and dessired to be supplied, and hee assuring them that they might speed, and freely goe<br />
in and out, the said Tompson went ahsore with him to the Governour and<br />
