To thwe first Interogatorie hee saith hee … To thwe first Interogatorie hee saith hee is a ffisherman of Milton and doth<br />
pretend right as a ffisherman (and beleeveth hee may lawfully doe soe) to<br />
fish and dredge for oysters in the grounds Interrogate, the same being (as<br />
hee hath predeposed) reputed to be common to all ffishermen and to be an<br />
arme of the sea And further to this Interrogatorie hee cannot answere/
To the 2 hee saith hee doth beare a part of the charge of this suite,<br />
and is to contribute towards the maynteyning thereof, and doth endeavour<br />
and desyre to obteyne a power to fish in the grounds Interrogate, (as hee<br />
beleeveth hee lawfully may, And further to this Interrogatorie hee cannot answere./
To the 3 Interrogatorie hee saith that for these thirty yeares last hee hath<br />
knowne and observed that the ffishermen of ffeversham tennants of the<br />
mannor and hundred thereof have constantly fished and dredged upon<br />
harty shoare the Pollard East Swale the [?Beacon] and Nesse grounds<br />
And further to this Interrogatorie hee cannot answere./
To the 4th hee saith that ever since hee this deponent<br />
wasa a fisherman which is about thirty two yeares last the ffishermen<br />
of ffeversham have challenged a right of fishing in tyhe grounds<br />
Interrogate exclusive to all other persons not being of the Mannor and<br />
hundred of ffeversahm, but by what authority they doe soe hee knoweth<br />
not nor hath heard And further saving his answere to the next precedent<br />
Interrogatorie and his foregoeing deposition hee cannot answere./
To the 5th and 6th Interrogatorie hee saith hee well remembreth about two moneths<br />
since one John Eaton ffisherman of Milton was (as hee hath heard) trawling<br />
for fish upon the hrounds in question, and was interrupted by Mathew<br />
Adams and one [BLANK IN MANUSCRIPT] Stevens ffishermen of ffeversham and his trawle<br />
by them cut away, for which the sayd Eaton did (of this deponents<br />
knowledge take out a writt out of this Court against the sayd Adams and Stevens<br />
for disturbeuing him in his fishing and cutting his trawle and this deponent<br />
knoweth that the sayd Adams and Stevens did compound with the sayd Eaton<br />
in this deponents and the producent Arkenstalls presence<br />
and agreed to pay the sayd Eaton three pounds for their trespasse, and as<br />
this deponent hath heard did pay him forty shillings thereof and promise<br />
to pay him the other treaty in a short tyme after An hee further saith that<br />
about a yeare last past henry haycock of Milton ffisherman being (as hee heard)<br />
dredgeing for oysters upon the grounds in question, was interrupted by some<br />
of the ffishermen of ffeversham (but by whome of them hee knoweth not)<br />
and had his boate taken away from him by them (as hee hath heard) and<br />
as hee hath heard they doe still keepe the same boate from him And further to<br />
