To the 5th article of the sayd allegation … To the 5th article of the sayd allegation hee saith that the reparation of<br />
the quarter of the ''Exeter Merchant'' and other things broken about her<br />
by reason of her hawser being cutt as aforesayd, and the new mooreing of<br />
her, did cost her Owners (as hee beleeveth) a very considerable summe<br />
of money, but how much hee certainely knoweth not for that hee sawe not<br />
the money paid but beleeveth it could not amount to lesse then thirty<br />
pounds sterling And further hee cannot depose./
To the 6th hee saith hee referreth himselfe to the Registry of this Court<br />
and further cannot depose./
To the 7th hee saith hee well knoweth that what damage is happened to the<br />
''Exeter Merchant'' and her goods, or to the ''Pilgrim'' and her goods, soe happened by the<br />
wilfullnes and carelessenes of the arlate Thomas Smith and his Company,<br />
and by their cutting loose of the ''Exeter Merchants'' hawser as aforesayd and<br />
turning her on drifte, And hee saith hee is well assured that if the sayd Smith<br />
had not caused some of his Company to cut the sayd hawser the damage<br />
predeposed of had not happened, And further hee cannot depose./
To 8th hee saith hee referreth himselfe to the Registry of this Court and<br />
further cannot depose./
To last hee saith his foregoeing deposition us true./

To the first Interrogatorie hee saith hee was Quartermaster of the ''Exeter Merchant''<br />
at the tyme Interrogate./
To the second and third Interrogatories hee saith hee was present and aboard the ''Exeter''<br />
''Merchant'' at the tyme Interrogate and saith the premisses by him predeposed of in his deposition<br />
to the second third and 4th articles of the allegation were soe done in the afternoone of<br />
the day (the tyme more certainely hee doth not now remember) and that there were<br />
present besides the company of the ''Exeter Merchant'' one Merrit a waterman then alsoe<br />
on board the ''Exeter Merchant'', and others whose names hee remembreth not,<br />
And hee saith that hee is about 42 yeares of age, and hath bin a Mariner these<br />
sixe or eight and twenty yeares last past, and hath knowne and observed the<br />
Customes by him predeposed of to be used during all or the most part of that tyme And<br />
further hee cannot answere./
To the 4th hee saith the shipp ''ffrancis and Mary'' did at the tyme Interrogate<br />
lye at the lower chayne at Lymehouse outward bound, but was not then in the<br />
acte of receaving goods on board her, and saith hee heard some of the Company<br />
of the ''ffrancis and Mary'' saye that they had goods to come on board, and withall well<br />
remembreth that the sayd Woodfin and some of his company thereto replyed and<br />
sayd thus or the like in effect that they would not hinder them the Company<br />
of the ''ffrancis and Mary'' from takeing in any goods, but would vere a sterne,<br />
or hale to the other side of their shipp, or doe any thing that was fitt, soe they<br />
might but fasten to the ''ffrancis and Mary'' till they could fasten their<br />
shipp ''Exeter Merchant'' to the chayne aforesayd, this hee knoweth being aboard<br />
the ''Exeter Merchant'' and hearing those or the like words uttered and spoken And<br />
further hee cannot absweare./
To the 5th Interrogatorie hee saith that hee knoweth that it is a usuall thing for<br />
