Merchant, where he hath dwelt about two<br />
yeares last past, aged about 28 yeares<br />
a wittnes produced and sworne and being<br />
examined hhe deposeth and saith as followeth<br />
videlicet/
To the first second and third articles of the said<br />
allegation he deposeth and saith That he the deponent<br />
hath by the way of commerce or merchandizing knowne the<br />
arlate Joseph Perera for about two yeares last past<br />
And he deposeth that in or about March last he the<br />
deponent received a letter from the sayd Joseph Perera<br />
advising him that Antonio Rodriguea de Morais his<br />
the sayd Perera's ffactor in ffrance had freighted<br />
a shipp to goe from thence to Portugall, and there to<br />
lade oyles and other goods and to returne to ffrance with the sayd oyles<br />
and other goods wither to haver de Grace or Roane for<br />
his the said Pereras Accompt, and that the sayd<br />
oyles being (as the sayd Letter mentioned) sixty pipes<br />
and some Sumacke were already laden aboard the<br />
shipp for his Accompt at Porta Port in Portugall And further he cannot<br />
depose Saving that it is very evident unto him the deponent<br />
that the sayd Perera was and ought to be the Lawfull<br />
Owner of and Proprietor of the goods aforementioned,/
To the fourth article he deposeth that he saw in the Registry<br />
office a bill of Lading for the goods belonging to the sayd<br />
Perera taken aboard the said shipp at the time of her<br />
seizure which he beleiveth is firmed or subscribed by the arlate<br />
Ryer Cornelison, And further he deposeth not.
To the fifth Article he deposeth and saith that<br />
he having seene the paper arlate, which he taketh to bee the<br />
bill of Lading by him predeposed of, that it is sayd in the<br />
sayd bill of Lading that the goods were to be delivered at<br />
Amsterdam, which he sayth is meerely colourable, and<br />
very usuall amongst Merchants for the securing their<br />
goods in case of capture, But the deponent saith that<br />
his Letter of advice from Perera was otherwise, and<br />
that advised this deponent that the goods aboard the<br />
said shipp were consigned to Antonio Rodrigues de Morais<br />
his Agent in ffrance and to be to him there delivered<br />
at Roane or haver de grace, And further<br />
he cannot depose.
