that the ffishermen tennants of the sayd mannor had and ought to have sole priviledge exclusive<br />
to all other persons whatsoever to fish in the sayd grounds and watercourses<br />
tyme out of mynde and memory of men now living And saith that within these twenty yeares last hee hath knowne divers<br />
ffishermen belonging to other places neere adioyning videlicet to Milton and<br />
Stroud arlate sued by the ffishermen tennants of the Mannor and hundred of ffever=<br />
sham aforesayd in the Court of the Exchequer for fishing in the sayd grounds without the leave of<br />
the Tennants of the sayd Mannor of ffeversham and that they have<br />
compounded with the tennants of the mannor and hundred of ffeversham aforesayd<br />
for soe doeing and acknowledged them selves trespassers therein<br />
And saith that tyme out of mynde and memory of men now liveing<br />
the same grounds have bin (as hee hath heard by Common fame and repute) accompted to belonge to the sayd mannor<br />
and hundred and to be part thereof and that noe ffishermen either of Strowde Milton holstowe Gillingham<br />
nor other places adiacent nor any other save the ffishermen tennants<br />
of the sayd Mannor and hundred of ffeversham ough tto fish in the sayd grounds<br />
And further to this allegation hee cannot depose, saving hee saith the producents<br />
have bin Commonly as is allegate for divers yeares and soe Accompted

on the behalfe of the sayd William Luson and<br />

To the first article of the sayd allegation hee saith and deposeth<br />
that hee being a tennant of the Mannor and hundred of ffeversham<br />
and a ffisherman knoweth that within these twenty yeares last<br />
the Tennants of the sayd mannor and hundred have often tymes<br />
stored the oyster grounds arlate now in question called jarty shoare<br />
otherwise the Nebb, the [?Beson] ground the Nesse ground and Pollard ground<br />
with osters at their owne charge and expended therein some yeares<br />
thirty pounds and some yeares more and some yeares lesse according as<br />
necessitie required, and hee this deponent hath within the sayd<br />
tyme brought oysters of Essex and other places bought by the sayd Tennants with their money to store<br />
the sayd grounds and hath knowne divers<br />
other tennants of teh sayd mannor and hundred of ffeversham<br />
doe the like when occasion required which hee saith they did because<br />
the sayd grounds and the right of ffishing in them did wholly<br />
belonge to the tennants ffishermen of the sayd mannor and<br />
hundred of ffeversham and to noe other ffishermen thereabouts<br />
and saith the ffishermen tennants of the sayd Mannor and hundred<br />
