County of Middlesex mariner aged twenty sixe yeares or<br />
thereabouts a wuttnesse sworne and examined saith as followeth<br />
videlicet./
To the first Interrogatorie hee saith the shipp Interrogate (whose name hee<br />
knoweth not) was found by the Company of the shipp the ''Lyon'' (then in the<br />
service of this Commonwealth and on her voyage homewards from the West<br />
Indies) in this condition here after expressed videlicet, the sayd shipp Interrogate<br />
was found upon the streame about sixteene leagues south from the lands<br />
end, her hold being then full of water up to the gunne deck, her yardes and<br />
riggeing being all shattered and torne and lying upon the deck utterly unser=<br />
viceable, there being noe person liveing in her, And hee saith that<br />
Captaine John Lambert Commander of the ''Lyon'' aforesayd having soe<br />
found her in that condition ordered Thomas Trippett late Booteswaine<br />
of the ''Paragon'' with some thirty sixe persons of the Company of the ''Lyon''<br />
to goe on board the sayd shipp soe found to doe their endeavour to save her<br />
if they could and they according to his order went on board her the twenty<br />
eighth day of August last and continued on board her till about twelve a<br />
Clock on the twenty nynth of the same, and then the sayd Trippett perceiving<br />
the sayd shipp to be in a very dangerous condition likely to perish and<br />
the water encreaseing in her notwithstanding all the endeavour hee and his<br />
sayd Company could use, did for preservation of his life returne on<br />
board the shipp Interrogate, and there related what a dangerous<br />
condition shee was in and that hee did conceive it was impossible to save her<br />
from foundering in the sea and thereupon caused a protest to be drawne in<br />
these words following videlicet '''By this present Instrument of a protest done and protested<br />
against the sea and against the Shipp Rack taken by Captaine John Lambert<br />
Commander of the States Shipp the ''Lyon'' on the twenty nynth day of August<br />
for not being able to convoye her noe further for the preserving of the sayd Rack<br />
wee doe by these presents protest against the shipp and seas, and it is ordered by<br />
the Captaine that Lieutenanant John Gough doe take charge of the goods that<br />
are in the sayd Rack and to gaine the first port that hee can gaine and<br />
there to report unto the Vize Admirall, and to make a protest and declare it<br />
publiquely there that soe done and protested in the presence of us on board the sayd<br />
stated shipp ''Lyon'' this one and thirtith day of August 1655/''' and subscribed Tho: Trippet<br />
which protest being soe made was sent to this deponent then remayning on<br />
