late commander of the said shipp the<br />
''John'' of dover aged 33 yeares or thereabouts<br />
sworne before the right worshipfull William Clarke<br />
doctor of lawes one of the Judges of the high Court<br />
of the Admiraltie, and examined upon certaine<br />
Interrogatories ministred on the behalfe of the said Vincent<br />
dela Barr and Thomas dela Val, saith and deposeth<br />
as followeth videlicet.
To the first and second Interrogatories hee saith and deposeth that<br />
hee well knew and was commander of the said shipp the ''John'' of<br />
dover at the time of her last being at Saint Lucars and<br />
Cadiz in Spaine, (which waas in the yeare 1652) and thence bound<br />
for this port of London, And saith that hee hath well knowne<br />
the producents Vincent delabarr and Thomas delaval for theise<br />
tenn yeares last, and that at the time of the said shipps departure<br />
from Cadiz homewards the said voyage they were the sole<br />
owners of the said shipp and pf her tackle, apparell and furniture,<br />
which hee knoweth because this deponent was constituted master of her<br />
by them the said delabarr and delaval who hee saith fitted<br />
and sett her out the said voyage as sole owners of her. And<br />
further that shee departeds from Spaine on the said homewards voyage<br />
in or about the moneth of January of the said yeare 1652, in which<br />
said homewads voyage, in the latitude of 45 degrees and a halfe<br />
shee was met with by a Squadron of shipps under the command<br />
of Prince Rupert, which chased and endeavoured to take her, and<br />
that the said shipp the ''John'' fought and defended herselfe (as<br />
much as shee was able) from about eight in the morning till<br />
about three of the clock in the afternoone with greate hurt and dammage<br />
namely hee saith that in the said fight shee received about 150 shott<br />
from the said Squadron in her masts, sailes, rigging and hull<br />
whereby the same were very much torne and battered, the charge<br />
of the repaire and amending whereof and to make the said shipp<br />
therein as good as shee was before the said dammage received, came<br />
to and cost her said owners fifteie pounds sterling, all which hee<br />
knoweth being master as aforesaid and seeing the premisses soe<br />
donne, and laying out the moneys (on behalfe of the said owners)<br />
in and for such her necessarie repaire of the hurt and dammage<br />
sustained by the said fight and chase, wherein it pleased God<br />
to deliver her from being taken by the said Squadron. And<br />
saith that since the said voyage and fight namely about a yeere<br />
since, the said shipp, tackle and furniture were sold for 255 ''li''<br />
sterling and noe more, which hee knoweth being privie to the<br />
said sale and receiving the said moneys on the behalfe and to the<br />
use of the said owners And otherwise hee cannot depose.
