Transcription hee were the Owner and proprietor of them hee were the Owner and proprietor of them hee knoweth not And that at the<br /> same tyme there were aboard the sayd shipp twenty butts of wine or thereabouts which<br /> were consigned to be delivered to the arlate Richard Baker And that at<br /> the same tyme there were aboard the sayd shipp sixe butts of oyle which<br /> were consigned to be delivered to the arlate George Clarke this hee knoweth<br /> being Master of the shipp the ''Pilgrim'' and seeing the sayd wines and oyles laden<br /> aboard her And further to this article hee cannot depose./ To the 2 3 and 4th articles of the sayd libell hee saith that in the yeare 1655<br /> and in or about the moneth of June that yeare the arlate shipp the ''Pilgrim''<br /> laye at Anchor with the goods and Merchandizes predeposed of on board her<br /> neere dicks shoare in the River of Thames in a safe and convenient place where<br /> shipps use to ride and that in the tyme of her soe rideing at Anchor there<br /> the arlate shipp the ''Exeter Merchant'' whereof was then Master the arlate<br /> Thomas Woodfin did by the carelessenesse and negligence of the sayd<br /> Woodfin and Company came and drave crosse the hawse of the ''Pilgrim''<br /> and brake the Cable and boltspritt and head and drave her<br /> on shoare with all her sayd ladeing above mentioned and also severall<br /> other goods on board her wherewith shee was deepe laden<br /> belonging to other persons besides the foresayd Bathurst Baker and Clarke<br /> by meanes whereof the sayd shipp ''Pilgrim'' being deepe laden as aforesayd<br /> was much wronge and hurte and became thereby very leakie<br /> and many of the Casks wherein the oyles belonging to the arlate<br /> Bathurst and Clarke were conteyned became thereby very leakie<br /> and this deponent and Company of the ''Pilgrim'' shortly after her being<br /> soe driven on shoare by the meanes aforesayd makeing use of their<br /> pumpe to cleare the sayd shipp ''Pilgrim'' of water did thereby finde<br /> that there came up a very great quantitie of oyles at the pumpe<br /> and that hee this deponent and company haveing<br /> deiver tymes within a fortnight next before such her being driven on<br /> ground pumped the sayd shipp well knoweth that there came very<br /> little oyle up in that tyme at the pumpe before sych her being driven on shoare<br /> And alsoe saith that hee beleeveth that by reason of such her being driven<br /> on shoare some casks of wine belonging to the arlate<br /> Richard Baker became alsoe leakie, for that hee sawe afterwards<br /> that some of themn had leaked out a good quantitie of the wine that<br /> was in them, but whether any of the wines soe leaked out came up at<br /> the pumpe hee cannot depose it being a thinge not to be discovered<br /> as oyle may bee, the premisses hee deposeth being then Master of the<br /> ''Pilgrim'' and on board and an eye wittnesse of them And further to<br /> these articles hee cannot depose/ To the 5th article hee saith that hee knoweth that a good quantitie of<br /> oyles belonging to the arlate Bathurst and Clarke and beleeveth some wines<br /> belonging to the arlate Baker, were leaked out by the meanes<br /> aforesayd, but the number of butts hee knoweth not, but saith for that<br /> hee had oyles then on board for his owne Accompte hee knoweth that oyles were then<br /> worth twelve or fowerteene pounds sterling a butt And further to this article<br /> hee cannot depose./is article<br /> hee cannot depose./  +
