this deponent tooke a coppy of the letter sent to the sayd Cowse by the<br />
sayd Proby and Watts, And further to these articles hee cannot depose/<br />
saving hee saith hee well knoweth the sayd Probie and Watts and<br />
saith they are Englishmen and Merchants of good repute in Saint<br />
Lucar./

To the first Interrogatorie hee saith hee is noe way related to the sayd Keene<br />
saving the sayd Keene made use of him as aforesayd to assiste him in<br />
the disposall of some goods of his owne at Saint Lucar and in the endeavouring<br />
to procure Mariners as aforesayd, and saith hee was forced by<br />
a Compulsorie shewne him by an Officer of this Court to come and testifie in this cause And to the rest<br />
of the Interrogatorie hee answereth negatively/
To the 2 hee saith the vessell Interrogate was repayred at Saint Lucar<br />
and made fitt to proceed on a voyage and for that noe Mariners<br />
could bee there procured to proceede to Palma the sayd Keene did<br />
take there a freight for London and further hee cannot depose./

a witnes sworne and examined saith and deposeth as followeth
To the first article hee saith hee cannot depose for that hee knew not the ''John''<br />
''and Elizabeth'' before her arrivall at Saint Lucar upon the voyage arlate/
To the 2: 3: 4th and 5th articles of the sayd allegation hee saith that hee this deponent<br />
being in Spaine shortly after the arivall of the ''John and Elizabeth'' at Saint Lucar<br />
did come to Saint Lucar and at his comming thither found the sayd vessell the ''John''<br />
''and Elizabeth'' lying in the harbour there, and observed that shee<br />
had bin very much hurt and damaged and had only a Jurie<br />
mast standing which was put up at sea to bring her into any harbour that she<br />
could most conveniently make to And hee saith that hee heard one Laarson<br />
the Mate of the saud Vessell saye, and alsoe heard a common reporte to the same<br />
effecte amongst other seamen and Mariners at Saint Lucar, that the sayd Vessell had<br />
endured much stormie weather at sea before her comeing in thither and that<br />
a shipp called the ''Supply'' whereof one ffluite as it was reported was master, had and<br />
did fall fowle of her the ''John and Elizabeth'' and brake downe her masts and<br />
her midshipp and did her other damage, and that her company (sall save her Master, and his said mate and a boy) seeing the same<br />
and fearing shee would perish in the sea imediately upon the sayd damage receaved<br />
