To the 2 3 and 4th articles of the sayd allegation hee saith that after the sayd departure of the<br />
sayd Mr Ceely from Saint Lucar (from whence hee went as feareing and having heard a rumour hat a<br />
warr would breake forth betwixt England and Spaine to the preiudice and hinderance of<br />
trade) hee this deponent did at Saint Lucar about the end of July last receive a letter from the sayd Prigg<br />
directed from Saint Malloes to the sayd Ceely at Saint Lucar, and therein an Invoice<br />
and bill of ladeing incloased, by which bill of ladeing Invoice and letter it did<br />
to this deponent appeare that the sayd Prigg had laden aboard the shipp the<br />
''Crosse of Jerusalem'' five ballotts of linnen marked and numbred<br />
as in the margent and in the sayd Invoice was expressed that the same was laded

aboard the sayd shipp the nunteenth of June last and alsoe hee saith it was in the sayd letter and Invoice that the same was laden<br />
three 4th thereof for the Accompt of the sayd Ceely, and the other fowerth for<br />
the Accompt of the sayd Prigg, which bill of ladeing and Invoice, (for<br />
that hee this deponent alsoe heard the like rumour of a warr ready to brake<br />
forth betwixt Spaine and England and was then ready to depart from Saint<br />
Lucar for England) hee left at Cadiz with one Mr Alexander Southerland a Scott a factor<br />
there and desyred him to take care and dispose of the sayd goods at their comming And further hee saith hee beleeveth that it is frequent for Merchants in tyme of<br />
warr to make use of colourable names in their bills of ladeing for the better<br />
securing their Merchandizes in enymeies Countries in tyme of warr, and<br />
saith that in the sayd bill of ladeing which this deponent receaved there was<br />
a Colourable bamed used of one William Leterm, And further to these articles<br />
hee cannot depose./
To the 5th and 6th articles saving his foregoeing deposition hee cannot further depose/
To the 7th hee saith that hee this deponent having diligently perused the bill of ladeing<br />
and Invoice arlate, verily beleeveth and is perswaded in his conscience that the<br />
bill of ladeing arlate is one of the three originall bills of ladeing signed by<br />
the Master of the ''Crosse of Jerusalem'' for the five balletts of Canvas or linnen predeposed<br />
of, and that the Invoice arlate is a true Coppy of the originall Invoice for the sayd<br />
five ballotts of linnen or Canvas sent by the arlate Prigg to the arlate George<br />
Ceely with or in his letter of advice which hee this deponent receaved as aforesayd<br />
And further hee cannot depose/
To the last hee saith his foregoeing deposition is true/

To the first Interrogatorie hee saith hee is a Scotch man by byrth and hath lived at Cales<br />
and Civill in Spaine during all the tye Interrogate And to the rest of the<br />
Interrogatorie hee answereth negatively./
To the 2 Interrogatorie hee saith hee hath satisfied the contracts thereof as touching the sayd<br />
Ceely before, soe farr as hee can, saving hee saith the sayd Ceely till about two moneths<br />
last past, was a batchelour and ffactor there during the tyme Interrogated And saith hee knoweth not the Interrogate Prigg<br />
nor had any correspondence with him saving as predeposed And further hee cannot<br />
answere/
To the third saving his foregoeing deposition to which hee referreth hee cannot more fully<br />
