Transcription The sixth of July 1655/ [CENTRE HEADING] The sixth of July 1655/ [CENTRE HEADING] James Cowes of London Merchant against vessel the}<br /> ''John and Elizabeth'' of which Edward Keene is master}<br /> and against the saith Edward Keene Suckley Smith} Examined upon an allegation arlate given in the<br /> 31th of May 1655 on the behalfe of the sayd Cowsel/ '''2nd''' '''Thomas Burridge''' of the parish of Stepney and County<br /> Middlesex Mariner aged fifteene yeares or thereabouts a witnes<br /> sworne and examined saith and deposely at followeth videlicet./ To the first article of the sayed allegation hee saith and deposeth that in the yeare 1654<br /> and moneths therein ?connurring the arlate Edward Keene went Master of the arlate<br /> Shipp the ''John & Elizabeth'' and tooke upon him the charge & government of her as<br /> Master during the whole voyage in question and was Commonly reputed to be then<br /> Master and Commander of her for the sayd voyage The premisses hee deposeth for that hee<br /> this deponent was a Cabbin boy and servant to the sayd Master in the sayd shipp during the sayd<br /> voyage and further to this article he cannot depose./ To the second and third articles and schedule in the third article mentioned hee saith that the sayd shipp did about August last past sett out from this port<br /> of London upon the voyage in question and was designed (as this deponent hath heard) to<br /> have gone with her ladding (which was pipe staves and other goods but by whome laden this<br /> deponent knoweth, not, for that hee came aboard after the said ship had taken in all her<br /> ladeing and was ready to proceede on her voyage aforesayd) to Saint luca arlate, but saith by<br /> reason of an extraordinary storme which happened and for that in the sayd storme<br /> the sayd shipp ''John and Elizabeth'' was greatly dammified by another shipp running fowle of<br /> her in the right tyme the arlate Edward Keene did (being necessitated soto doe) put in with the sayd shipp ''John and Elizabeth''<br /> and her lading aboard there at st Lucar arlate where hee delivered unladed all his sayd<br /> ladeing the premises hee deposeth being then abroad and eye witnesse thereof<br /> and seeing the same happen and soe done at is predeposed and further to the sayd artices and schedule<br /> hee cannot depose./ To the 4th and scheduled therein mentioned cannot depose To the 5th saving his forgoeing deposition hee cannot depose/ To the 6th hee saith that hee this deponent being on board the vessel the ''John and Elizabeth''<br /> arlate at St Lucar and coming home to their port of London in her well knoweth the sayd<br /> vessel did at St Lucar aforesayd take in divers goods to be thence transported to<br /> London and did accordingly bring there to London and further he cannot depose To the 7th and 8th articles hee saith hee cannot depose/ To the 9th he saith hee referred him selfe to the Registry of the Court arlate<br /> and further cannot depose./ To the last hee saith his forgoeing deposition is true./ To the Interrogatories [CENTRE HEADING] To the first Interrogatorie hee saith hee was required to appeare and testifie his knowledge<br /> in this cause by a person whose name hee knoweth not, who told this rendent that if<br /> hee would not voluntarily appeare soe to doe hee should be compelled or to that effect<br /> and told this deponent if hee appeared and testified therein hee could not loose his labouer but promised this<br /> deponent nothing and saith it will bee noe benefitt or damage to this deponent that hee knoweth XXX which soe ever of<br /> the parties litigant prevaile in this cause and saith hee is not any waies allyed or<br /> servant to the producent nor expecteth any reward for his testimony save his necessary<br /> charges in attending thereabouts and ?famoneth both parties litigant alike in respect<br /> of this cause And further cannot answere./of this cause And further cannot answere./  +
