To the 9th, 10th and 11th articles of the … To the 9th, 10th and 11th articles of the sayd libell hee saith that the sayd Fare during
the whole voyage in question was very carelesse of his office and duties
as a pilott of the sayd shipp and kept noe Accompte of the sayd shipps way as
as a pilott ought to doe, that by that meanes hee might knowe where the shipp was upon all occasions
and avoide such dangers as usually happen by reason of such negligence, and soe
carelesse hee was in that periculer as that in returne of the sayd shipp
homewards from Druntam towards the Downes (some fowle weather
and contrary windes happening which put the sayd Shipp out of her course and
forced her upon the coast of Holland) hee the sayd Fare could not tell where
shee was but being demanded by the Master of the sayd shipp and Company
thereof where or neere what place the sayd shipp was to see what
answere hee would make thereto the sayd Fare could give noe Accompte where the sayd
shipp was but would and did name
places which were (of the knowledge of the Master and Company) twenty or thirty
leagues distant from the place shee was then at when such questions were asked
of him by the Master, soe that by the sayd Fare's carelessnesse and unskilfulllness
the sayd shipp in the sayd voyage both outward bound and homewards ran many
dangers, and lost much tyme in the prosecution of her sayd voyage and thereby
occasioned much damage to the Owners of the sayd shipp in
consuming victualls extraordinary and mens wages extraordinary for
the tyme that was soe lost and spent through his negligence and want of skill to
performe his duty, which damage in this deponents Judgement
and estimate could not amount to lesse then about 40 or 30 pounds
sterling And further to these articles hee cannot depose saving hee saith the
the sayd Fare is an old man and not able in this deponents Judgement, by reason of it, and other this
insufficiencies and carelessnes which this deponent observed him to be much addicted
toin the sayd voyage, to take charge of any shipp or vessell as a pylott thereof
from London to Druntam aforesayd or the ports therabouts./
To the 12th and 13th hee saith he referreth himselfe to his foregoeing deposition and
to the lawe and further cannot depose./
To the 14th hee saith the sayd Richard Fare is comonly reputed a subiect
of this Commonwealth and is subiect to the Jurisdiction arlate as this deponent
verily beleiveth./
To the last hee saith his foregoeing deposition is true.
