To the first and second articles of the sa … To the first and second articles of the sayd libell hee saith and deposeth<br />
that the arlate Gyles Travers in the moneth of January last was and is commonly reputed the true Owner and<br />
Proprietor of certaine pipes of Canarie wines laden aboard the arlate<br />
ship the ''John and Mary'' (William Webber arlate Master) And saith that in the<br />
sayd moneth of January severall pipes of the sayd Canarie wines were laden from<br />
on board the sayd ship ''John and Mary'' into and on board a certayne lighter whereof<br />
the arlate Thomas Tayler was Master in which lighter the sayd wines<br />
were carried to, and safely arrived at Bottolphs Wharfe, and there were<br />
safely moored with a stronge and sufficient hawser, and there continued soe safely<br />
moored from 10 of the clock at night till betwixt 5 and 6 of the next morning<br />
the premises hee deposeth being on board the sayd lighter, and imployed<br />
to helpe to watch and looke to the sayd wines while they were aboard the sayd<br />
lighter, And further to these articles hee cannot depose./
To the 3: 4th 5th and 6th articles of the sayd libell hee saith and deposeth<br />
that after the sayd Lighter laden with the sayd wines was soe moored at Buttolphs<br />
Wharfe, a lighter of the burthen of about 80 tonnes whereof one Pomeroy<br />
(as this deponent hath heard and beleeveth) was Master, which laye moored to a certaine shipp<br />
at Buttolphs wharfe which laye on head of the sayd lighter soe laden with<br />
wines as aforesaid, did unadvisedly and rashly veere (there being then<br />
a very stronge tyde of ebbe) towards the sayd lighter soe laden<br />
with wines, which hee this deponent and other Coopers on board the lighter<br />
laden with wines perceiving, and fearing the sayd Pomeroys lighter would<br />
fall fowle of the sayd lighter laden with wines as aforesaid and doe some<br />
mischeife and preiudice thereto, did call out to the sayd Pomeroy and Company<br />
and told him that there was a ladeing of wines on board the lighter hee<br />
this deponent was in, and wished him to have a care of falling fowle of her<br />
least they damaged her and her ladeing, which notwithstanding the sayd<br />
Pomery and Company still veered nearer the sayd lighter and with all<br />
gave this deponent and the rest of the Company of the sayd lighter laden<br />
with wines evill and uncivill language, (but the partuculers thereof this deponent<br />
remembreth not at present) alsoe continueing on their course in a willfull and carelesse manner fell fowle<br />
first of the shipps boate whereto the lighter laden with wines was moored,<br />
and split and sunke the sayd boate, and still continueing on their course by<br />
the like willfullnes and neglect fell fowle of the sayd lighter wherein the<br />
sayd wines were, and thereby brake her hawser<br />
and put her a drift, by meanes whereof and by reason of the sayd Pomeroys<br />
lighter falling soe violently fowle upon the lighter laden with wines<br />
a pipe of Canarie wines in the sayd lighter worth 30 ''li'' sterling or thereabouts<br />
was staved and utterly lost, which losse had not happened (as this deponent<br />
beleeveth) if the sayd Pomerie had not through his negligence and willfullnes<br />
fallen fowle with his lighter upon the sayd lighter laden with wines, the<br />
premises hee deposeth for that hee was on board and eye wittnes [?XX]<br />
as aforesaid imployed to looke to the sayd wines and thereby well observing<br />
all the passages predeposed And further to these articles hee cannot depose
