knowledge predeposed./
To the 4th hee saith, That the said shipp the ''goulden ffalcon'' did sett<br />
saile from Zeeland in or about the moneth of Aprill in the yeare <u>1652:-</u><br />
bound in her ballast for Bayonne in ffrance to seeke a freight, whicjh shee<br />
transported from thence to Mallega in the Voiage in Controversie, and<br />
saith that such her departure was before any hostility happened between<br />
England and holland, this deponent being in all that Voiage a Mariner aboard<br />
her, And saith, That although the said goods now Claymed were designed<br />
to goe for Middleborough yet this deponent for and upon the ground of<br />
knowledge and firme beliefe as predeposed, is verily assured in Conscience<br />
that the same were really and truely to be imployed and converted to the sole<br />
use and benefitt of the said producent, for whom (as then being ab exiled<br />
person from and out of the United Netherlands) one Leoanrt Thyson brother<br />
to the said producent did acte and negotiate upon that consideration. And<br />
further hee cannot depose:/
To the 5th hee saith, That the arlate daniel Thyssen the producent in<br />
this Cause formerly a Burgher and inhabitant of and in Tervier aforesaid<br />
was in or about the moneth of September in the yeare <u>1651.</u> banished<br />
out of the United Provinces by the Magistracie of Terveere, and declared<br />
utterly incapable of any benefit immunitie or priviledge of a subject<br />
there, whereupon hee was necessitated to depart the said Provinces, and<br />
to betake himselfe into fflanders where after hee had sojourned some<br />
time hee became a ffree Burgher of Ostend and a subject of the<br />
king of Spaine in the moneth of October <u>.1652</u>, and about the 18th<br />
day of the same as this deponent both by credible report, and upon sight<br />
of the said producents Burghers brief hath well observed, which was<br />
before the seizure of the shipp and goods in Controversie by the<br />
English, which happened upon the 10th of November <u>1652:-</u> and not<br />
before, And otherwise hee cannot depose, saving the said producents<br />
exile and abdication as aforesaid was and is publique and notorious in<br />
Zeeland, and other parts of the said United Provinces, And saving<br />
That since such his Burgershipp in Ostend hee did and doeth<br />
enjoy all the freedomes and priviledges to such a person belonging
To the last hee saith his foregoing deposition is true:-/

To the first hee saith, That hee this rendent was boateswaines mate<br />
aboard the shipp the ''Goulden falcon'' the Voiage in Controversie and<br />
when shee was seized, and came first aboard her to serve at<br />

To the second hee saith, That the said shipp was in or about the said<br />
