To the 5th hee saith, That hee this rendent is no house keeper of himselfe<br />
neither is hee in the quality of a servant to anyone, but is a<br />
Merchant who acteth and tradeth for himselfe, and for the time of<br />
12. yeares interrate, hee hath lived at London and Greenwich with his this rendents<br />
mother, one yeare or thereabouts in holland, and about 4. yeares at<br />
severall times in ffrance in the quality of a Merchant and Traveller or<br />
Sjourner and for his owne particular hath never payd any taxes or<br />
Contributions in any place in the quality of a house-keeper, neither abroad<br />
nor in England where hee alwaies lived under the government of his Parents.<br />
And further cannot depose:-/
To the 6th hee saith that so farr as this rendent knoweth all the goods<br />
and merchandizes lately seized aboard the said shipp were taken in att<br />
or neere haver de Grace in ffrance, and were, as hee beleeveth, all<br />
or most of them brought aboard the said shipp in hoyes from Roane,<br />
and were and are of the manufacture of ffrance, being linnen<br />
Cloath and other Merchandizes, of those parts:-/
To the 7th hee saith hee this rendent doeth not knowe whether the<br />
said Master have received any freight or part of freight for the goods<br />
interrate, neither doeth hee know or ever heard of any Charterparty<br />
of affraightment made for the Voiage in Controversy:-
To the 8th hee saith, hee knoweth nothing of or concerning any bill<br />
of sale of the said shipp, neither did hee ever see any moneys payd<br />
for the same.
To the 9th hee saith, That the said shipps crew at the time of<br />
her said seizure consisted of about 40 persons, but how many of<br />
them were hired or taken aboard her in ffrance hee saith hee<br />
knoweth not, neither cann he further answer, saving as this<br />
rendent remembreth there was one frenchman amongst them:-
To the 10th hee saith hee knoweth not whether any of the said<br />
shipps Owners have any goods aboard the said shipp for their accompt<br />
save onley hee beleeveth the said master who is accompted apart<br />
Owner of the said shipp hath some goods aboard her for his proper<br />
accompt, for which hee needed not to signe any bills<br />
of lading, And saith hee knoweth not whether there be any goods<br />
or merchandizes aboard the said shipp for which the said Master or his Purser signed<br />
no bills of lading, or bills of lading of contrary or different tenor<br />
for each or any mans severall parcell, Neither doeth hee know how many<br />
bills of lading of one tenor were signed for any mans parcell<br />
