Examined upon the sayd allegation

of Middlesex Mariner Quarter Master of the shipp the ''Levant''<br />
''ffrigott'' aged 28 yeares or thereabouts a witnesse sworne<br />
and examined saith and deposeth as followeth videlicet./
To the first article of the sayd allegation hee saith and deposeth that<br />
hee this deponent was a Quarter Master of the sayd shipp the ''Levant ffrigott''<br />
during the voyage in Question and knoweth there was carried in her the voyage afore=<br />
sayd noe pepper save about thirty baggs which<br />
were laden (as he hath heard and beleeveth for the Accompt of the arlate Andrewes<br />
and Clutterbrooke And saith that in the sayd shipps passage from London<br />
towards Allecant diver of the sayd baggs proved to be rotten and burst whereby<br />
much pepper rann out and rann into the bottom of the shipp and into the pumpe well<br />
thereof, and was first discovered by those who worked at the pumpe, and the same<br />
being discovered, the arlate haslegrave and Company did sett bread basketts and<br />
ballast basketts at the pumpe mouth to save the pepper as the pumpe brought it up, and<br />
dryed the pepper soe saved upon the decks and the same being dryed kept the<br />
same, and when the baggs were mended put some of it in one bagg and some into another<br />
as convenience offered to receave the same And saith the sayd pepper was pumped<br />
up at the pumpe for a good while (but for how many weekes hee knoweth not)<br />
and preserved allwaies when it came up, And saith the sayd shipp was a strong<br />
tight shipp and soe tight that noe goods receaved aboard her could receave<br />
any damage by any Leakines or defect in her, and soe still continueth, the<br />
premisses hee deposeth being an eye witnesse and a Quarter Master of the sayd<br />
shipp the voyage aforesayd And further to this article hee cannot depose for<br />
that hee came not on board the sayd shipp till shee was falne downe to dover<br />
Roade./
To the 2 article hee saith that of his sight and knowledge being at the<br />
unladeing of the same the sayd pepper was well stowed in the midst of the<br />
shipp a little abafte the mayne Mast and three tyre of Lead and bavins<br />
for dennage upon them were layed under the sayd pepper, to keepe and preserve the<br />
same the better from damage, and divers packs of perpetuanas and baggswere<br />
stowed on the topp of the sayd pepper, and knoweth that there were divers other<br />
packs of perpetuanas and bayes that laye some abafte and some before the sayd pepper<br />
but lower and neerer the bottom of the shipp then the sayd pepper did and receaved<br />
noe damage by reason of any wett, soe that hee thereby knoweth the sayd baggs<br />
of pepper could have receaved noe damage by any weltt receaved in the sayd shipp<br />
if the baggs had not bin rotten and soe suffered the same to runne out as aforesayd<br />
And in deede most of the sayd baggs were soe rotten that the arlate haslegrave<br />
and Company were forced to mend them with sayle cloathes and other canvas before<br />
they could remove them out of the hold to hoyse them over the shipp sides the<br />
premisses hee deposeth for the reasons aforesayd And further to this article<br />
hee cannot depose./
To the third article of the sayd allegation hee saith and deposeth that the<br />
sayd shipp the ''Levant ffrigott'' in her course towards Allecant was chased at<br />
sea by certaine dutch men of warr (there being then hostility betweene the dutch<br />
and English) and the arlate haslegrave and Company were forced the better to<br />
avoide being taken by the sayd men of warr and made prize, to come<br />
into Cadiz arlate, where they continued divers dayes and durst not make out<br />
to sea for feare of the dutch men of warr who hovered up and downe there<br />
neitherred up and downe there<br />
