aged 30 yeares or thereabouts sworne and examined.
To the first and second articles of the said allegation hee saith and deposeth That<br />
the seaventeene Rolls of Tobaccoe and all such ginger as were aboard the<br />
shipp the ''Leopard'' arlate at the time of her seizure at Bristoll were none<br />
of the growth of Saint Christofers arlate nor of any other of the Charibee<br />
Ilands under the dominion of the English, or of or belonging to the<br />
English plantation, which hee knoweth because hee this deponent was<br />
present and sawe the lading of the said tobaccoes and ginger at<br />
Martinica which is none of the English plantations, and there<br />
this deponent sawe the same bought of the Negroes of that place,<br />
where the same grew and were made, and further saith that<br />
not anty part of the other goods seized aboard the said shipp came<br />
from Saint Christofers or any of the Charibbe Ilands in the possession<br />
of or belonging to the English, which hee knoweth being aboard her<br />
upon her first going to Backstarr Roade, and continueing in her till<br />
her comming from those parts, and thereby well knowing that shee<br />
was not in the English plantation. And otherwise hee cannot depose.
To the third hee saith that hee well knoweth the arlate Richard Gibbs<br />
and saith hee was one of the company of the said shipp ''Leopard'' on the<br />
28th of September last new stile on which day this deponent came<br />
first aboard her at Backsterr as stiersman of her, and sawe the said<br />
Gibbs then aboard her, and was informed by the rest of the company that<br />
the said Gibbs came first aboard her three sayes space before this<br />
deponents said comming into her. And otherwise hee cannot depose
To the fourth hee saith that the said shipp the ''Leopard'' was at and<br />
continued in the Iland of Martinica in and untill the beginning of<br />
September last past namely untill about the tenth of September last<br />
And well knoweth that in all the space that this deponent was at<br />
Martinica before the said tenth of September, which was two or<br />
three monethes, the said shipp was of his sight and knowledge<br />
constantly at Martinica and never went in that space to Saint Christofers<br />
or to any part of the Iland soe called. And otherwise hee cannot<br />
depose.
To the fifth hee saith that the said shipp the ''Leopard'' when first<br />
she came the said voyage to Martinica, came from Guinney and<br />
bought Negro's thence in her, and there namely at Martinica<br />
the said Negro's were landed, and disposed of of this deponents<br />
sight and knowledge, and about the said tenth of September last new stile<br />
shee went from Martinica for Saint Christofers which was her first<br />
going thither after such her comming from Ginney. And othewise<br />
hee cannot depose.
