''Saint Mary'' aged 32 yeares or thereabouts<br />
sworne and examined.
To the first and second articles hee saith and deposeth that hee by wofull<br />
experience knoweth the producent ffrancisco Lopez, for that hee<br />
the said ffrancisco being a Spaniard and being aboard the said shipp<br />
the ''Saint Mary'' to goe passenger for Amsterdam with part of the occasion<br />
(there being alsoe other Spanish passengers aboard) that the said shipp<br />
was seized by Captaine Collard. And saith the said ffrancisco<br />
Lopez at Santa Cruze in the Ile of Teneriffe one of the Canary<br />
Ilands did in or about the moneth of June last past lade<br />
and caiuse to bee laden aboard the said shipp an hundred chests of<br />
sugar and upwards, and a quantitie of hides (but howe many<br />
hee knoweth not) to be thence carried in the said shipp to Amsterdam<br />
and there to be delivered, but for whose accompt they were laden<br />
and to whom belonging hee saith hee doth not knowe, neither<br />
knoweth hee ought of the Proprietie of the other claimers<br />
arlate in the goods by them claimed, nor knoweth hee the marke<br />
of the said goods laden by the said Lopez. And otherwise<br />
hee cannot depose
To the third 4th and 5th articles hee saith that after the lading and putting the said<br />
goods aboard the said shipp shee departed from Santa Cruze in the<br />
Iland of Teneriff for Amsterdam, and in her course for Amsterdam<br />
was met with and taken by one Captaine Collart pretending a<br />
Commission from the ffrench kinge, who tooke about twenty chests<br />
of sugar out of her, but did bot carry her into any port or<br />
under commannd of any fort or Castle in ffrance, shee was<br />
taken form him by the ''Saphire frigot'' belonging to this<br />
