Examined upon an allegation made by Mr<br />
Budd in the acts of Court the 6th<br />
of this instant. and a schedule therein<br />

27 yeares or thereabouts sworne and examined.
To the said allegation and to the exhibit therein mentioned beginning and<br />
ending as in the same is deduced, nowe showed unto him hee saith and<br />
deposeth that on or about the fourth day of January 1653, hee this<br />
deponent together with his contest Captaine Michael Robinson, and<br />
one James Bates were present with and in company of Captaine<br />
John Pibus allegated at the Castle taverne at Paulschaine<br />
London, and there they discoursed of and about a holland shipp which<br />
the said Pibus had taken in the shipp the ''Martha'' comming<br />
from Graenland, and which hee had letten goe againe, and then and<br />
there the said Pibus made a confession and a declaration touching the<br />
said shipp in all things as in the said schedule is sett downe, the<br />
contents of which schedule were writte downe by the said James<br />
Bates from the mouth and in the presence of the said Pibus and of<br />
this deponent and the said Robinson, and being soe written it was<br />
read verbatim over to the said Pibus, and hee the said Pibus alsoe read<br />
the same over himselfe and acknowledged the same to be wholly true<br />
and then and there hee the said Pibus with his owne hand subscribed<br />
his name thereto as nowe appeareth in the presence and sight<br />
of him this deponent and of the said Bates and Robinson, And<br />
otherwise hee cannot depose.
To the Interrogatories. [CENTRE HEADING]
To the first hee saith the said Pibus was a prisoner and under restraint<br />
at the time aforesaid of the said writing and acknowledging the contents<br />
of the said schedule, but saith hee was not urged or threatened to the<br />
said subscription by this deponent or any other in his hearing, but hee<br />
having made the said confession first verbally, this deponent and<br />
the said Robinson and bates desired him to give [?XX] [?under]<br />
his hand, which hee willingly did, and saith the said Pibus was then<br />
a prisoner to this deponent and Captaine Robinson, who had a<br />
speciall warrant for his apprehension, and had him then in their custodie<br />
And otherwise saving as aforesaid hee cannot answer.
To the second hee saith that hee [?prosequuteth] the said businesse<br />
according to act of Parliament, without expectation of any benefit<br />
thereby, but for the service of the Commonwealth, and hee<br />
desireth that Justice may take place, and referreth himselfe to<br />
the act of Parliament in that behalfe touching any share that should<br />
accrew unto him, denying that ever hee or any other to his knowledge<br />
threatened the said Pibus to the effect interrogated or otherwise<br />
And otherwise saving as aforesaid hee cannot answer
