To the 4th hee saith that the sayd leake and mayne night being mended the<br />
sayd shipp againe set out to sea from Cadiz to goe for England but about<br />
the sixth of ffebruary last past in the English Channell mett with an other very<br />
violent storme which alsoe continued the space of eight howers and more and beate<br />
with such violence upon the sayd shipp that the waves often washing over<br />
the decks thereof shee could not in all probability but receive in much<br />
water And saith that in case any damage have happened to any of the<br />
sayd shipps ladeing, the same was occasioned by the violence of the<br />
foresayd stormes and not by any defect of the sayd shipp for that hee knoweth<br />
the sayd shipp before the sayd stormes happened, was tight and sufficient and soe<br />
still is, And for that hee knoweth that the Company of the sayd shipp did<br />
their utmost endeavour (both by carefull stowing the goods in her, and diligent<br />
plying the pumpe soe often as occasion required) to revent and damage<br />
being done to the sayd shipps ladeing And further hee cannot depose./

''Mary and Anne'' aged twenty three yeares or thereabouts<br />
a witnes sworne and examined saith and deposeth as<br />
followeth videlicet./
To the first and second articles of the sayd allegation hee saith that hee this<br />
deponent being Gunner in the shipp the ''Mary and Anne'' arlate well knoweth that<br />
in the moneths of November and december 1654 the sayd shipp was a very<br />
tight and stronge shipp and fitt to carrie any Merchandizes and in the sayd moneths<br />
laye at the Port of Mallega in Spaine and there tooke in divers goods and<br />
Merchandizes to be thence transported to London And saith the sayd shipp<br />
sett sayle from thence with the sayd goods for London in the sayd moneth of december<br />
and about the 22th of the same moneth the sayd shipp being<br />
neere the Southward Cape met with a very violent storme which<br />
continued at least fower and twenty howers with such violence that the sayd<br />
shipps company were forced to take in all their sayles and durst beare noe<br />
sayle out. for feare the same should have bin the occasion to cause the sayd shipp<br />
and goods to perish and founder in the seam and soe violent the sayd storme was<br />
that although the sayd shipp bore out noe sayle yet it forced her to drive and<br />
kye alonge upon her side in the sea whereby shee could not possibly but receive<br />
and did receive much water aboard her The premisses hee deposeth seeing the<br />
same being Gunner as aforesayd aboard the sayd shipp the sayd voyage<br />
