the Governor of Portsmouth say that Captaine Philipps<br />

To the allegation made in the Acts of Court and to the schedule<br />
therein mentioned and by him this deponent read and perrused at<br />
this his time of examination he deposeth and saith That he<br />
the deponent was one of the Company of the allegate shipp the<br />
''Constant'', and that he was present and aboard her when the said<br />
shipp and her Company tooke and seized a hoye laden with<br />
herrings, a shipp called the ''Joseph'' laden with salt, prunes<br />
vinegar and other goods, and a shipp called the ''Concord'' laden<br />
with Bahia Sugars and Shemack and other goods and alsoe<br />
a shipp called the ''Dolphin'' loaden with pitch and rossin and<br />
the shipp called the ''Winter king'' loaden with Rye, and alsoe<br />
a shipp called the ''Island of [?XXXing]'' with her loading of<br />
[?XXX] commodities, and a hoye called the ''hope'' laden with [?XXX]<br />
and alsoe a vessell called the ''fflower pott'' loaden with pewter<br />
and nayles, All which sayd prizes were brought into<br />
Portsmouth and there delivered into the custody of the allegate<br />
Captaine Philipps, who made sale thereof, And that all<br />
the persons mentioned in the allegate schedule were of the said<br />
shipp the ''Constant'' her Company, and employed out by the<br />
said Captaine Philipps, who promised to pay the said shipps<br />
Company the thirds, and he saith that the sayd shipp and her<br />
Company was in the imployment of the said Philipps<br />
in taking the aforementioned prizes for about eight monethes<br />
And further he cannot depose.
