To the fourth hee saith that the tobaccoes arlate were delivered out<br />
of the warehouses at Portsmouth to the use of the said Wainewright<br />
and Jefferies, but the time hee remembreth not, not having<br />
here his bookes and notes whereby to informe his memory, and<br />
saith they were taken into the possession of Mr Burton<br />
(by them appointed to receive them) from this deponent, And<br />
otherwise cannot depose.
To the 5 hee saith that the said tobaccoes could not be nor were<br />
delivered out but with the permission and privitie of the<br />
officers of the Customes at Portsmouth, for hee saith they had<br />
locke on the warehouses wherein they were put and laid, and<br />
saith that Cullerton of the Customes there declared and acknowledged<br />
(as this deponent remembreth_ himselfe satisfied for the said customes when the said deliverie<br />
was soe made, which hee knoweth for the reasons aforesaid,<br />
And otherwise hee cannot depose.
To the 6th hee saith that by common usage and custome in this<br />
place and parts arlate, tobaccoes are not delivered out of the<br />
warehouses wherein the same are laid and whereof the officers<br />
of the customes have keyes, untill the customes for the same be<br />
paid, or satisfied and being delivered, the customes are commonly reputed<br />
to be paid or satisfied, which hee knoweth being a merchant, and having<br />
bin an officer for the state for prize goods. And otherwise<br />
hee cannot depose.
To the 7th hee saith that neither this deponent nor, as hee<br />
beeleeveth any officer or Commissioner for prize goods was privie<br />
or consenting to any such seizure as is arlate, nor had any<br />
notice that any such seizure was intended, And otherwise<br />
hee cannot depose.
To the 8th hee saith hee cannot depose.
To the 9th nad 10th hee saith that the said Mr urton<br />
imployed on the behalfe of the said Wainewright and Jefferies<br />
for the receipt of the said tobaccoes, did not upon the receipt<br />
thereof finde any fault ot take any exceptions at the<br />
consition thereof, but received the same as well conditioned<br />
which hee knoweth because hee this deponent delivered the<br />
same, And otherwise hee cannot depose.
To the 11th hee saith that the Commissioners for prize goods<br />
nor their officers were not nor gave any cause or occasion (soe<br />
farr as hee knoweth or beleeveth) of any dammage whatsoever<br />
to the said tobaccoes) And otherwise hee cannot depose
To the 12. 13 and 14th hee saith that hee was informed by one<br />
that was his partner in his said office, that the shipp<br />
