Transcription whether the sayd Maples have hyred any marwhether the sayd Maples have hyred any mariners to serve in the sayd<br /> shipp ''Thomas and Lucie'' his intended voyage for Spaine or Portugall, nor what<br /> rates hee payeth for them, but beleeveth hee may hyre mariners there to goe<br /> that voyage at as cheape or cheaper rates then the mariners hyred at<br /> London for the voyage in question were hyred at/ To the 13th article of the libell hee saith that since the sayd shipp the ''Thomas and Lucie''<br /> and the arlate Maples the Master of her came first to Bristoll as aforesayd, the<br /> sayd Maples did at Bristoll in the presence and hearing of this deponent and<br /> his precontest Richard Vaughan<br /> and one Mr Crofts a Merchant of Bristoll sayd and confesse that after<br /> the first storme (in this cause predeposed of) was over, hee was moved by his<br /> then shipps company to proceede on his first voyage to Naples and<br /> Lepra or else to make for some port of Spaine or Portugall and that<br /> hee might then have sayled to any of the sayd ports or places if hee would,<br /> or to the like effect And further hee cannot depose./ To the 14th hee saith that the arlate bartle, hamblin, and Company of the<br /> ''Thomas and Lucie'', besides their want of cloathes and necessaries predeposed of alsoe<br /> well sawe and knew by the relation of the Carpenters who viewed the sayd shipp<br /> that shee was soe insufficient that they could not with safety adventure to sea<br /> in her but that they should be thereby in danger to perish by her foundering<br /> in the sea And further saving his foregeoing deposition hee cannot depose/ To the 15th hee saith that the whole company of the sayd shipp ''Thomas and<br /> Lucie'' did serve in her from the tenth of June last (which day they entered<br /> into full pay as aforesayd at Gravesend) till the 26th of december last<br /> during all which tyme they all of them according to their severall offices and<br /> imployments in the sayd shipp did faithfully serve and discharge their<br /> dutyes therein And further hee cannot depose saving hee saith (as formerly<br /> hee hath deposed) that the arlate Peter Barllet did serve as Carpenter in the<br /> sayd shipp, and (as hee hath heard and beleeveth) entered into whole pay<br /> the space of half a moneth next before the sayd 10th day of june last soe<br /> that hee served seaven months in the sayd shipp the premisses hee deposeth<br /> being one of the sayd shipps company the voyage in question/ To the 16th article hee saith that the monthly rates mentioned in the schedule<br /> arlate to be due to the Mariners therein alsoe named are usually payd<br /> to Mariners of other shipps such as the ''Thomas and Lucie'' is, and goeing upon<br /> the like voyage as the voyage in question, and capable of the like service<br /> as the Mariners in the sayd schedule named did and performed in the sayd<br /> shipp ''Thomas and Lucy'' the voyage in question And further hee cannot depose<br /> not being privie to the bargaine made with them by the Master of the ''Thomas<br /> and Lucie'' when hee hyred them./ To the 17th hee saith hee was present when the shipp ''Thomas and Lucies'' company (and this<br /> deponent amongst others of them) did demand the pay due to them for the voyage in question<br /> of the arlate Broderick and hatton who denyed to pay the same and saith it is still unpaid<br /> to their great damage And further saving his precedent and subsequent depositions cannot depose To the 18th hee referreth himselfe to the Registry of this Court and further cannot<br /> depose./ To the 19th hee saith the Company of the shipp ''Thomas and Lucie'' aforesayd<br /> have bin and are greatly damnified vidliect to the value of 100 ''li'' sterling or thereabouts as<br /> hee beleeveth by the arlate Broderick Hatton and Maples their refusing to pay them<br /> theireir refusing to pay them<br /> their  +
