and served in and aboard the said shipp as aforesaid, and thereby having<br />
very goods knowledge of and acquaintance with the sid Master and Owners<br />
as is predeposed And further cannot depose/:-
To the second hee saith, That in the yeare <u>1652.</u> arlate, the said shipp<br />
the ''Charity'' being at Wexford in Ireland was there by the said Master<br />
in the name of himself and of his said fellow Owners lett to freight<br />
to the arlate ffrancis harvey a Merchant of Wexford, to goe<br />
with a lading of herrings from thence to Bourdeaux, but in their<br />
Course thitherwards were by contrary wind constrained to putt into<br />
Waterford in Ireland, whence by thesaid Merchants ffactors direction<br />
they went in Companie with five saile of English shipps bopund with<br />
[?Toreis] for Saint Sebastians in Spaine, and about 2. moneths after their<br />
arrivall there, by the said factors direction, shee sett saile from thence<br />
for Bourdeaux, and in her Course thitherwards was taken by<br />
a hollands Merchant shipp bound for Bayon in ffrance, and was<br />
there brought up, and the said harrigate and company were<br />
turned out and dispossessed of the same, and saith That the Master<br />
or Commander of the said Merchants shipp being examined before the<br />
Governor of Bayon, did, as this deponent then and there credibly heard<br />
from the said factors and from the Master of the said Vessell the ''Charity''<br />
declare, that hee had no Commission or authority for the seizure of the<br />
said shipp the ''Charity'' and her lading, The premisses hee deposeth, for that<br />
hee served in and aboard the said shipp all the Voiages aforesaid as<br />
Boateswaine thereof, and was brought in her to Bayon upon the<br />
seizure aforesaid. And further cannot depose/:-
To the 3. hee saith, hee hath not seene the shipp ''Charity'' allate since<br />
hee left her aty Bayon after her said seizure, and therefore cannot<br />
depose anything as to the identity of the said shipp, and the shipp now<br />
in Controversie/
To the 4th hee referreth himselfe to the acts of this Court. And further<br />
cannot depose./
To the 5th hee saith his foregoeing deposition is true:-/
