To the first article of the said Allegation hee saith and deposeth, That in or<br />
about the moneths of June and July in the yeare <u>1650.</u> last past<br />
the arlate Andrew Rand then or not long before Captaine or Commander<br />
of the shipp ''Thomas and Lucy'' of London then being under sequestration<br />
at the Bahia in the Brazeele, did then and there cause to be laden and<br />
putt on board the shipp the ''Nostra Seniora da Rosario'' arlate (whereof<br />
this deponent then was Commander) Tenn Chests of white sugar marked<br />
as in the margent to be transported from thence to Lisbone in Portugall

for and upon the proper accompt and adventure of the said Andrew<br />
Rand. The premisses this deponent well knoweth, for that hee this deponent<br />
being Captaine and Commander of the said shopp the ''Nostra Seniora''<br />

ten Chests of sugar for the accompt aforesaid aboard the said shipp at the<br />
time and place aforesaid, And to that purpose this deponent concluded and agreed with<br />
the said Andrew Rand to and for the transporting of the said sugars as<br />
is predeposed, And further, saving his subsequent depositions, to which hee<br />
referreth, hee saith hee cannot depose./
To the second article and schedules therein mentioned and thereunto annexed<br />
and now seene and perused by this deponent hee saith and deposeth, That<br />
hee this deponent being the then Master and Commander of the said shipp the<br />

goods predeposed signe and firme to three bills of ladeimng all of one tenor<br />
