To the 9th Article of the said Allegation … To the 9th Article of the said Allegation hee saith and deposeth, That hee this<br />
deponent being as hee hath predeposed, present and residing in Saint Mallo aforesaid<br />
in the moneths of September and October <u>1653.</u> the goods wares and Merchan=<br />
dizes of the said William Pym and sewerall other English Merchants being then<br />
and there seized upon by the ffrenchmen of Saint Mallo in manner and upon<br />
pretence as is predeposed, severall of the Inhabitants of the said Towne of<br />
Saint Mallo did with much violence and in a barbarous manner assault and<br />
iniure the English then there resideing, in this deponents sight, this deponent being<br />
severall times so iniured, and having stones throwne at him, so that he and the<br />
rest of the English could not passe along the streetes without an imminent<br />
danger of their lives for a long time together; And saith, That in or about<br />
the moneth of december next ensueing after the injuries and insolencies aforesaid<br />
hee this deponent together with the wife and family of the said William Pym<br />
perceiving themselves exposed to continuall dangers by an enraged multitude, did<br />
privately retire and convey themselves away into England, and upon such their<br />
retreat were necessitated to leave all the estate the said William Pym then had<br />
remaineing there, as a pray to the incensed ffrench, And the said William Pym<br />
was and is by that meanes totally deprived not onely of the beneficiall employment<br />
which hee had and enjoyed as a ffactor there, but also of all and singular the<br />
emoluments and advantages which hee made by his owne particular adventure and<br />
negotitation And thereby hath clearely suffered losse and dammage since<br />
his said necessitated retreat to the full valew of three thousand pounds sterling<br />
or thereabouts, as this deponent (who was and is familiarly acquainted with the said<br />
producents begotiation) doeth well knowe, and in Conscience fully assured<br />
And further cannot depose./
To the 10th Article hee saith, That the said William Pym the producent in this Cause<br />
hath since the seizure of his goods Wares and merchandizes in manner as is predeposed<br />
sought and endeavoured to have reparation and satisfaction for the same from<br />
the ffrench, and in order thereunto, hath petitioned and presented his said letters<br />
and grievances, to the Court of Judicature at Saint Malo, to the Parliament of<br />
Rhennes in Brittanie being the Parliament under whose Jurisdiction Saint Malo<br />
is scituated, and also to the great Councill at Paris, and in prosecution of<br />
his just demands to and before the said respective Courts of Judicature<br />
and Councill hath necessarily expended and layd out one hundred and<br />
sixtie pounds sterling or thereabouts, but hath not, nor can obtaine from them any [?repara= GUTTER]<br />
tion or satisfaction for the dammages and losses aforesaid nor for any part<br />
thereof. The premisses this deponent well knoweth by reason of his familiar<br />
and constant conversation with the person, and acquaintance with the afaires<br />
and transactions of the said producent William Pym. And further<br />
cannot depose./
