for the reasons hereafter particularly expressed. And otherwise cannot depose.
To the second and 3rd Articles hee saith and deposeth, That hee this deponent hath <br />
knowne the arlate John Smeesters the producent for these 6. yeares last<br />
past or thereabouts to bee as he at present is a Merchant of Antwerp who <br />
hath driven and still driveth a Constant trade to Cadiz St Lucas and other<br />
Parts in Spayne, where hee had and hath this ffactors and Correspondants<br />
residing for the management of his Merchants affaires, to whom hee hath<br />
that time sent severall goods wares and Merchandizes of very great values<br />
to bee sould and disposed off by them for his accompt and returnes thereof<br />
to be by them made unto him in silver plate and moneys, And saith<br />
That in or about the monethes of July August September and october <br />
in the yeare 1652 last past John Lamotte and Gerard Ryper factors to and<br />
for the said producent, did lade or cause to bee laden for his accompt and<br />
adventure on board the shipp the ''Sampson'' whereof Otto George is Captaine<br />
all and singular the pieces of eight mentioned in the first schedule predeposed<br />
and marked with the first marke in the margent, and on board the shipp<br />
the ''Salvadore'' (Christian Cloppenburgh Master) all and singular the pieces<br />
of eight predeposed, and mentioned in the second schedule aforesaid, and marked<br />
with the second marke expressed in the margent, and on board the shipp <br />
the ''Saint George'' (John Martins Dorp Master) all and singular the<br />
pieces of eight predeposed, mentioned in the third schedule annexed to the 5th<br />
Allegation, and marked with the third and 4th markes expressed in the margent, <br />
all to be transported in the said shipps from Cadiz to Ostend, and<br />
there to bee delivered to the said producent or his Agents or assigned on his<br />
behalfe, and for his use and accompt. Which hee knoweth being Cashier and<br />
Bookekeeper to Mr Edward Peters a familiar friend and kinsman of this<br />
producent, by which meanes this deponent for severall yeares last past hath beene<br />
usually admitted to the knowledge of all the merchandizing affaires of the said<br />
producent, and hath seene and perused his bookes of accompts for all Merchan-<br />
dizes silver and moneys sent out or received by the said producent, And particularly<br />
this deponent shortly after the lading of the severall parcells of monies as aforesaid<br />
saw and perused letters of advise with bills of lading inclosed from the said ffactors <br />
