surprize all the sayd six barrs of sylver … surprize all the sayd six barrs of sylver were all of them aboard the sayd<br />
shipp ''Sampson'', and came into the possession of him that tooke the sayd shipp<br />
this deponent being a passenger in her from Cadize aforesayd and being aboard<br />
her att the tyme of the sayd seizure. And further he cannot depose.
To the fifth he saith that the arlate Antony de Ponte was and is a Spaniard<br />
borne in Teneriffe and of the Canarie Islands and was and is a subiect of<br />
the King of Spayne, And this deponent hath knowne him for ten or<br />
eleven yeares now last past to [drive] a trade of merchandizing betwixt<br />
the West Indies, and the Canaries and other places under the jurisdiction<br />
of the sayd King of Spayne. And for and as a Spaniard and a subject[] of<br />
the sayd King the sayd producent is commonly accounted and taken and otherwise <br />
he cannot depose.
To the sixth he saith that for the reasons by him formerly sett forth he this<br />
deponent knoweth that the sayd six barrs of sylver were laden aboard <br />
the sayd shipp ''Sampson'' for his [the] producents owne proper accompt & att his owne proper<br />
hazard and Adventure, and the same should have beene[] delivered to him for his owne accompt<br />
in case the shipp had safely arrived att Oostend. And further he cannot<br />
depose.
To the seventh he refereth himselfe to his depositions which he saith were<br />
and are true and otherwise he cannot depose.

To the first he saith that he this Rendent as a Passenger about the middle of<br />
September last as he remembreth embarqued himselfe in the shipp Interrate<br />
in the Bay of Cadize. And further he cannot depose.
To the second he saith that the sayd Antonio da Ponte was borne att Teneriffe<br />
and there hath his hanitation and family of the knowledge of this Rendent for<br />
about eleaven yeares. And further cannot depose.
To the third he saith that the sylver interrate was laden aboard the ''Sampson'' about<br />
the beginning of August last past. this deponent being then present, and the<br />
producent and the sayd Pasquall Andrada with him was then also present<br />
But the sayd producent did lade the same for his owne Accompt, as he hath<br />
predeposed. And otherwise he cannot depose.
To the fourth he saith that the sayd sylver was laden in the day tyme by the<br />
sayd Don Antonio da Ponte himselfe, and the purser of the ''Sampson'' Pedro da<br />
Campo receyved the same aboard. And further he cannot depose.
To the fifth he saith that he this deponent saw the sayd Pedro da Campo Viela<br />
signe the bills of lading interrate aboard the shipp ''Sampson'' then riding<br />
att an Anchor within the bay of Cadiz, upon or about the sixth day of<br />
September 1642. new stile as he hath predeposed. And otherwise he cannot<br />
depose.
To the sixth he saith by vertue of his Oath that he doth not know or beleive the<br />
Bill of lading interrate to be fictitious and colourable but knoweth it to be <br />
true and reall according to the verity of the matter. And otherwise he cannot<br />
depose.
To the seventh he saith that the Purser of the ''Sampson'' made entryes of the <br />
sayd sylver with markes and numbers in a booke and to whom the same was<br />
consigned and att [] port to be delivered. And otherwise he cannot depose.
To the eighth he saith that he knoweth that the sayd sylver was laden by the <br />
party that is mentioned in the bill interrate, which as this deponent beleiveth doth<br />
agree with the sayd Pursers booke. And otherwise he cannot depose.
