there weighed. And further saith that the … there weighed. And further saith that the sayd barrs being so bought<br />
and weighed as aforesayd the sayd Antonio de Ponte of the knowledge and <br />
sight of this deponent laded them aboard a merchants shipp belonging<br />
to the Galleons the name of which shipp was the ''Saint Juan Baptista''<br />
whereof was Master or Commannder John Sericho, to be from the Havana<br />
aforesayd transported for the Accompt of the producent to Cadize in Spayne<br />
whither the sayd shipp the ''Saint John Baptista'' the sayd barrs being aboard<br />
safely arrived, where as well as att the Havana this deponent saw<br />
in the quiet possession of them. And otherwise, saving that for lawfull<br />
Owner and proprietor of the same the sayd Don Antonio is [commonly]<br />
accompted he cannot depose, and saving that the sayd producent departed<br />
from La [vera] Cruz about the month of May, sett sayle from the Havana<br />
in June, and arrived att Cadize aforesayd about the latter end of July 1652
To the second Article he saith that after the arrivall of the ''John Bapti[sta]''<br />
att Cadize, he this deponent saw the arlate Don Antonio de Ponte<br />
bring the sayd six barrs marked as aforesayd from and out of the sa[yd]<br />
shipp the ''Saint John Baptista'' and lade the same upon the arlate shipp<br />
''Sampson'' whereof was and is Captaine or Master Otto George for the use<br />
Accompt of the sayd Antonio de Ponte to be transported from Cadize [to?]<br />
Ostend and there to be delivered to him the sayd Antonio for his owne Accompt this depon[ent]<br />
being there aboard the ''Sampson'' and seeing the Purser of the sayd [shipp]<br />
make and deliver to the producent a note or Receipt of the sayd s[ylver]<br />
barrs, so as aforsayd laden, and to be transported and delivered as af[oresayd]<br />
there being then likewise on board (besides this deponent the sayd P[urser]<br />
and the producent) one Roderigo Alonzo, and Pasquall Andrada <br />
produced as witnesses in this cause. And further he cannot depose sav[e]<br />
that the sayd producent came along in the sayd shipp from Cadize <br />
aforsayd, this deponent being likewise a Passenger in the same.
To the third he saith and deposeth that after the lading of the sayd bar[rs]<br />
of sylver as aforsayd, and more particularly upon or about the six[th]<br />
day of September new stile 1652. the arlate Pedro de Campo the <br />
Purser of the sayd shipp the ''Sampson'' signed three bills of ladeing<br />
all of one tenor for the sayd six barrs of sylver, whereof the bill [of]<br />
Lading to the allegation annexed and now shewne to this deponent att [the]<br />
tyme of his examination is one, this deponent being then [present] (and [?saw]<br />
the sayd Pedro de Campo (who as he saith was then Purser of the sayd sh[ipp]<br />
signe the same, as also did the aforesayd Roderigo Alonzo, and Pas[quall]<br />
Andrada as this deponent beleiveth. And he further saith that the [?sayd]<br />
Bills were all of them signed aboard the ''Sampson'' and the Contents of<br />
them were and are true of this deponents certayne knowledge. And <br />
otherwise he cannot depose.
To the fourth he saith and deposeth that after the lading of the sayd<br />
barrs of sylver and signing of the sayd Bills the sayd shipp the ''Sam[pson]''<br />
sett sayle and departed from Cadize toward Ostend, and in her<br />
direct Course thither meeting in the English Channell with a<br />
frigott of the State in whose Companie the sayd shipp ''Sampson'' [?and ?the]<br />
two other shipps the ''Salvador'' and ''Saint George'' sayled into the<br />
Downes, there as she was riding at Anchor seized by a f[rigott]<br />
of this Commonwealth as is arlate. And att the tyme of the sayd<br />
surpriz[?all]tyme of the sayd<br />
