precontest with others whose names this deponent doth not particularly<br />
Remember, and the same being so firmed in the sight and presence<br />
of this deponent and his sayd precontest and others delivered to the<br />
sayd Lewis ffernandez Angell, being then aboard the sayd shipp the <br />
''Sampson''. And he saith that the Bill of Lading or Schedule annexed<br />
to the allegation and showne unto him now att the tyme of his examination<br />
is one of those three Bills of Ladeing so signed as aforsayd by the sayd <br />
Pedro the Purser, this deponent knowing it by the markes of the <br />
sayd sylver thereon, and haveing seene it firmed as aforsayd, And<br />
saith further that he this deponent likewise saw this bill aboard the<br />
''Sampson'' in the Custody of the producent in the [Course?] of the sayd shipp<br />
toward [Ostend?], and doth verily believe that the same was aboard the<br />
''Sampson'' att the tyme of the seizure arlate in his the sayd producents<br />
Custody and possession, and somuch the producent after his arrivall<br />
att London told and acquainted this deponent, and was as this deponent<br />
likewise beleiveth sent or delivered into this Court by the produrent<br />
or some other person in his behalfe. And further he cannot depose for<br />
referring himselfe to the sayd Bills of Lading, the Contents whereof he beleiveth are true.
To the fourth he saith and deposeth That the sayd shipp the ''Sampson''<br />
having aboard her the sayd thirteene barrs of sylver in the month of<br />
October last past this deponent the arlate Lewis ffernandez Angell<br />
and his sayd precontest Don Antonio de Ponte being aboard her and<br />
all bound for Ostend, sett sayle and departed from the sayd Bay of <br />
Caddize and in her Course to Ostend in the English Channell about<br />
a month after her departure from Caddize together with some<br />
other shipps that sayled along with them was mett with taken and<br />
surprized by the shipps of this Commonwealth, the sayd sylver arlate<br />
being then aboard, this deponent knowing the premisses as being<br />
aboard as aforsayd att the tyme of the sayd seizure, and thereby<br />
likewise knowing that the barrs of sylver arlate came to their<br />
possession of the Takers of the sayd shipp. And otherwise he cannot<br />
depose.
To the fifth he saith and deposeth that the thirteene barrs arlate were<br />
Laden aboard the ''Sampson'' as aforsayd for the onely and proper use and<br />
Accompt of the sayd Lewis ffernandez Angell, and not for the use or<br />
Accompt of of any Subiect of the arlate States of the united provin[c]es<br />
nor had any [person] besides the arlate Lewis ffernandez, as this deponent<br />
for the reasons aforesayd knoweth and is fully perswaded, any right<br />
title or interest therein or any part thereof. And otherwise he cannot depose.
To the sixth he saith and deposeth that he this deponent knoweth that<br />
the arlate Lewis ffernandez Angell is by Nation a Spaniard, and to<br />
this deponents knowledge, hath bene for theis thirteene yeares now last past<br />
an Inhabitant of Caracas in the West Indies under the Jurisdiction of<br />
the King of Spaine, And for and as a subiect of the sayd King was and<br />
is comonly accounted reputed and taken. And otherwise he cannot depose.
To the seventh he referreth himselfe to the foregoeing depositions<br />
which he saith are true and further he cannot depose.
