moeny and plate as is predeposed and which since that<br />
have as aforesayd bin sent overland from Spania to fflanders and from<br />
thence hither the contents whereof are true and were soe had and<br />
done as therein is conteyned to which for fiurther satisfaction<br />
herein hee referreth himselfe. And further cannot depose.
To the 7. an 8th articles of the said Allegation hee saith and deposeth<br />
that after the said money and plate now claimed was laden on<br />
bord the said ship the ''Morning Starre'' and as shee was in her<br />
Course from Cadiz towards Dunquirke shee was mett withall<br />
surprized and taken by some of the ships of this Commonwealth<br />
and by them was brought into this Port of London att which tyme<br />
all the money and plate now claimed together with two other of the<br />
said bills of ladeing soe signed by this deponent were on bord<br />
her and came to the hands and possession of the sayd takers thereof<br />
which hee knoweth being then Commander of and abord the<br />
said shippe. And otherwise cannot depose. saving that in case<br />
the said ship had not (as she was and is) bin taken shee had sailed<br />
directly to Dunquirke and had there delivered the plate and money now<br />
claimed to the said Christopher Deinsart or to his Agents for his<br />
use and accompt.
To the 9.th hee saith his foregoeing deposition is true.
To the Interrogatories. [CENTRE HEADING]
To the first Interrogatorie hee saith hee came first on bord the said<br />
shipp at [BLANK IN MANUSCRIPT] about [BLANK IN MANUSCRIPT] yeares since and was Commander<br />
thereof when shee was taken. And further cannot depose.
To the second third 4th and 5th. Interrogatories hee saith that hee<br />
doeth not knowe the person of this producent, but saith hee is<br />
comonly and generally accompted a fflandrian by birth and habitation<br />
And saith hee well knoweth Giles de Ruela one of the laders of the<br />
money and plate now claymed. but the name[?s] of the other partie<br />
in the first bill of ladeing mentioned hee saith hee knoweth not<br />
but saith hee is (as hee beleeveth) a Spaniard, and the said de Ruela<br />
is a fflandrian by birth And both the said parties were in this deponents<br />
company on shore at Cadiz when they laded the said plate, And<br />
further cannot depose his foregoeing deposition towhich he referreth./
To the 6th hee saith that hee this Examinate signed all the<br />
bills of ladeing interrogated on shore in the house of Peter [?Jansen]<br />
the Purser in Cadiz att or about the tyme that the said money<br />
and plate now claimed was laden on bord the said shippe<br />
And further saveing his foregoeing deposition hee saith hee<br />
cannot depose.
To the 7th hee referreth himselfe to his foregoeing deposition<br />
And otherwise answereth negatively. />
