a witnes sworne and examined deposeth<br />
and saith as followeth videlicet./
To the 1. 2. 3 and 4th Articles of the sayd allegation This deponent saith that being<br />
att the port of Puenta Demas in Gallicia within the Dominions of the<br />
King of Spayne about the latter end of december and beginning of<br />
January 1648. he then and there saw the arlate shipp then called the<br />
''John Adventure'' (and since as it seemes called by some Hopewell, by others<br />
the ''Pidgeon''.) lye in the sayd port in the quiet and peaceable<br />
possession of the arlate Samuel Travis the then Owner thereof<br />
who on or about the seventh day of the sayd month of January for<br />
the somme of two hundred and forty pounds sterling sold alienated<br />
and made over the sayd shipp tackle and furniture to the foresayd<br />
John Giles party in this Cause, by a Bill of sale<br />
which moneyes this deponent saw payd by the sayd Giles to the sayd<br />
Travis, and the sayd Bill thereupon signed sealed and delivered<br />
by the sayd Travis to the sayd Giles for the sayd shipp. And saith that the<br />
schedule to the sayd allegation annexed and now shewne to him this Examinat<br />
was and is the sayd very originall Bill of sale, and the Contents<br />
thereof were and are true and the same [?and] was really signed sealed<br />
and delivered by the sayd Frowy or his Act and deed to the sayd Giles in the presence of this<br />
deponent and others whose names are subscribed as witnesses att the<br />
foot thereof,<br />
and saith he saw the sayd Travis putt the sayd Giles into the<br />
quiet and actuall possession of the sayd shipp. And further saith that<br />
the sayd shipp in the sayd bill of sale and att the tyme of making thereof<br />
called and knowne by the name of the ''John Adventure'', and the shipp<br />
''Hopewell'' or ''Pidgeon'' now in Controversy aboard which this deponent<br />
hath lately bene in this River of Thames was and is one and the the same<br />
shipp and not diverse. And otherwise cannot depose.
To the fifth sixth and seventh Articles of the sayd allegation This deponent<br />
saith that the sayd John Giles having bought the sayd shipp and her tackle<br />
and furniture as aforesayd continued in the quiet possession of her till<br />
about the latter end of the summer 1651. about which tyme this deponent<br />
happening to be att Brest in ffrance saw the sayd shipp there arrive and<br />
John Giles in her as Master, who then acquainted this deponent that he was<br />
driven in thither by a Turkes man of warr. And saith the sayd John Giles<br />
of this deponents sight was in the quiet possession of the sayd shipp att rest<br />
aforesayd for some tyme, and that soone after he saw the sayd shipp with her lading violently taken<br />
out of his possession by the Governour of Brest but upon what ground hee<br />
knoweth not, and saw the sayd Giles himselfe and shipps Companie<br />
violently seized on and imprisoned by the sayd Governour, but how longe they<br />
were so deteyned knoweth not. And beleiveth from that tyme to this present in the<br />
sayd shipp hath bene kept out of the quiet possession of the sayd John Giles. And further<br />
he cannot depose.
