borne in Hamborough where hee hath lived a … borne in Hamborough where hee hath lived all his tyme and is<br />
now a free Burgher of and in that citty where this deponent allsoe<br />
dwelleth and therefore knoweth the premisses to be true. And<br />
further cannot depose.
To the last hee saith his foregoeing deposition is true./
To the Interrogatories [CENTRE HEADING]
To the first Interrogatorie hee answereth negatively to every part<br />
thereof, sayeing that hee neither knoweth or hath heard<br />
any thinge to th effect interrogated And further cannot depose
To the second Interrogatorie hee saith that hee for his part cannot read<br />
written hand very well but can write enough to serve his owne private use<br />
And saith that the said Charter partie is written in the Hamburgher tongue<br />
for the contents whereof hee referreth him selfe thereunto And otherwise<br />
saveing as aforesaid hee answereth negatively.
To the third Interrogatorie hee saith hee was never at Bayon before this<br />
present voyage And otherwise hee saith hee cannot depose.
To the 4th hee saith that hee knoweth that the said wines in question were<br />
bought and laden for the use and accompt of the said John Temmin[?g]<br />
because hee was present when the same were soe bought and when<br />
the said Van Elen paid for the same with the proceede of the said wheat<br />
And further cannot depose saving his foregoeing deposition./
To the 5th hee answereth negatively to every part thereof./

Merchant aged 60 yeares or thereabouts sworne<br />
and Examined.
To the eleaventh article of the said Allegation hee saith and deposeth<br />
That it was and is the usuall and ordinary thing practized by<br />
ffactors resident att Bayone and other Parts of france who have<br />
laden or doe lade any goods on board any ship to be from thence<br />
transported to Hamborough or to any other place beyond the Seas<br />
for accompt of the Merchants beyond the Seas to whom they are consigned<br />
and for whose accounts they were and are really laden to eneter and Register<br />
the same in the Custome howse in Bayone or else where in ffrance<br />
where the said goods are laden as and for the goods of the ffactor[?s]<br />
who laded the same and as laden for them the said ffactors where<br />
as in very truth the said goods and Merchandizes soe entred and<br />
laden did not nor doe att all in pointe of propoertie belong to<br />
