To the 6 and 7th articles of the said Libe … To the 6 and 7th articles of the said Libell hee saith and<br />
deposeth that after the decease of the said Hobby in the Bu[?nn]eeme<br />
River and after such tyme as the said ship the ''Mary Constant''<br />
came backe againe into Cormantine Road in Guinney to the<br />
ship the ''Arrana Merchant'' the arlate Henry Evans in this deponents<br />
presence and heareing came abord the said ship and did then and<br />
there demand and seize upon all and singular the said goods<br />
and Merchandizes schedulated and tooles and clothes of which the said Hobby dyed<br />
[XXXXed] and the same did take away with him and carry away from thence<br />
and converted them to his owne use without giveing any accompt<br />
thereof either to the producent or any body else that this deponent knoweth<br />
or hath heard of. How beit hee saith that before such tyme as the said<br />
Evans tooke away the said goods from abord the ''Mary Constant'' David<br />
Tuckerman the Master of the said ship would not let them goe before hee<br />
gave him a receipt for them under his hand whereupon the said Tuckerman<br />
tooke pen and Inke and wrote a receipt for the same, to which the<br />
said Evans in this deponents presence did sett his hand and soe had the<br />
said goods Tooles and clothes carry from abord that ship with him. And<br />
further hee cannott depose saveing that at such tyme as the said Evans<br />
soe seized upon the said goods schedulated they were of this deponents<br />
knowledge well worth all and singular the sommes of money in the<br />
said schedul[?a] conteyned and Expressed. and for soe much the same<br />
might at that tyme have there bin sould to others;
To the 8th article hee cannot depose.
To the 9th hee saith that the said Henry Evans was and is an English[?e GUTTER]<br />
man and a subiect of this Comonwealth and one who thereby is as had [XXXXX GUTTER<br />
subiect to the Jurisdiction of this Court And further hee cannot depose
To the 10th hee saith that what hee hath predeposed is true.
To the Interrogatories. [CENTRE HEADING]
To the first Interrogatorie hee saith that hee cometh requested by the producent<br />
to testifie in this cause and saith hee expecteth no[?e] thing save such an allowance [?for GUTTER]<br />
his charges and expences for soe [?doeing]. and that hee oweth noe man<br />
a farthing, but hath hee thanketh god enough with his blessing to<br />
mayntayne him by his owne fa[XXX] Endeav[?ares] And otherwise<br />
hee cannot depose.
To the second Interrogatorie hee saith that hee was not of the company of the<br />
ship the ''Arrana Merchant'' interrogated in the voyage interrogated but did belong<br />
unto the ship the ''Mary Constant'' when the said Lawrence Hobby[?e GUTTER]<br />
dyed abord her as hee hath predeposed to which hee referreth himself[?e GUTTER]<br />
And saith that hee knewe the Interrogated Andrew king but [?whether GUTTER]<br />
hee bee an honest man or noe hee knoweth not, but saith hee<br />
hath heard some men give himnoe very good report.
To the last Interrogatorie hee answereth negatively saying that hee [XXX GUTTER]<br />
knew or heard any thing to the effect interrogated And<br />
otherwise referring himselfe to his foregoeing deposition hee saith hee<br />
cannot depose.
