To the third and fourth articles of the sa … To the third and fourth articles of the said Allegation hee saith and deposeth That<br />
at such tymw as the said ship the ''Arke of Noah'' was surprized and taken bu the<br />
''Harry'' which was upon or about the 28th day of July last the said Andrew Hayer together<br />
with the Skipper of the said ship came aboard the ''Harry'' and in the Captaine's cabbin of<br />
the said shipp (they still supposing her to bee a man of warre belonging to<br />
the Scotts King) did voluntarily and of theire owne accord acknowledge and confesse<br />
the said shipp with the said Horses to bee bound for Scotland for the King of Scotts uses wherefore<br />
the said Hayer did in his danishe Tongue desire the said Thomas Awres in this<br />
deponents presence and [XXXX]ing and the hearing of his precontests to convoy the said<br />
shippe to dundee or Aberdeene for which doeing hee then said hee would give him a<br />
hundred dollars. or soe in effect. And saith That at the said tyme of the seizure of<br />
the said ship shee was in direct course for Scotland and quite out of her way<br />
for Holsten. which hee knoweth because that the winde at that tyme was att south<br />
and by East which is well knowne unto all that knowe those parts to bee quite contrary<br />
to carry a ship from Berghen or any place thereabouts to Holsten. but on the contrary hee<br />
saith it was a afaire winde from thence for Scotland. And further hee cannot depose<br />
saveing that when the said shipp was soe seized this deponent was a Quarter master of an (sic) abor[?d]<br />
the said ship the ''Harry''.
To the 5. and 6th Articles of the said Allegation hee saith and deposeth That<br />
after such tyme as the said ship the ''Arke of Noah'' was seized and surprized by the<br />
''Harry'' the said producent Thomas Awre in this deponents presence and heareing did aske<br />
the said H[?ayer] the said s[?h]ipper where theire papers cocquets or charter parti[?a]<br />
for their said loading were unto whom the said Hayer replyed That hee had none<br />
and that hee had made two severall voyages to Scotland from Berghen this very [?Somer] besides this in which hee<br />
was not taken in both which hee affirmed that hee carryed horses from thence for the<br />
Use of the Scotts King. And that hee in neithar of those voyages had any paper<br />
or writing abord with him concerneing the same. or to the very same effect And<br />
further hee cannot depose.
To the seaventh hee cannot depose save only that hee saith that the master and company<br />
belonging to the ''Arke of Noah'' as hee beleeveth were all danishe men.
To the lasty hee saith that what hee hath predeposed is true.
To the Crosse Interrogatories. [CENTRE HEADING]
To the first Interrogatorie hee saith that hee this Examinate did goe out upon his present<br />
designe in and with the ship the ''Harry'' upon the Termes of Noe Purchase noe pay And saith<br />
that in regard hee hops to have his Shares (as a Quarter master) of the said shippe<br />
the ''Arke of Noah'' and horses abord hee had therefore [?does] and will doe his uttmost endeavor<br />
by all lawfull meanes to get her condemned as prize. And further<br />
hee cannot depose.
To the second Interrogatorie hee saith that hee canne a little speake both the ffrench and<br />
the Spanish tongues and doeth inderstand some words of the danishe Language<br />
And saith hee cometh at the instance of Captaine Thomas Awres the producent to testifie<br />
in this cause. And otherwise hee answereth negatively to the rest of the said Interrogatorie<br />
save only That the interrogated Mr. Southwood (being a part owner of the said<br />
ship the ''Harry'') doeth for what concernes himselfe very much labour to get this ship<br />
the ''Arke of Noah'' and goods condemned for prize. but what share he is to have<br />
thereof hee for his part knoweth of.
To the third Interrogatorie hee saith that hee doth not knowe of any goods or cloths which<br />
were taken out of the said ship the ''Arke of Noah'' save the tyme of the very first<br />
seisure thereof untill the present tyme. And further hee cannot depose<br />
saveing his foregeoing deposition to which hee referreth himselfe.
To the fowerth Interrogatorie hee saith that the severall and respective words by hi predeposed to<br />
bee said and spoken by the said Hayer and [?S?hipper] of the said ship the ''Arke of Noah''<br />
were soe said and spoken at such tyme and in such place as aforesaid in the<br />
danishe tongue, many words whereof this deponent could and did well understand<br />
and further saving his foregoeing deposition he saith hee cannot depose.
To the last hee sith hee hath not soe deposed
