the 23th day of July last past in the Even … the 23th day of July last past in the Evening was mett withall<br />
by Captaine Archer in one of the State ships and by him was<br />
commanded to strike saile and send his papers abord which<br />
the said Sybraut Jallis Captaine of the ''Stockholme'' forwith did and sent three of his company<br />
abord the said Archers ship with his said papers and to give him an account<br />
of his voyage, which said men and papers the said Archer detayned and<br />
then sent two of his owne company aboard the ''Stockholme''<br />
who demanded the said Jallis to come out of his owne shippe<br />
and to goe with them abord the said Archers and in the meane<br />
while let the other three ships (two whomeof were dutch and one a<br />
Dane) goe and depart without any search or visitation of them which being<br />
procured by the said Jallis hee presently conceived the said Archers<br />
ship to bee an Irish man of warre or some other privat in regard hee soe<br />
let the other vessells goe and detained him alone notwithstanding<br />
that hee had given him an accompt of his voyages; hee therefore<br />
did refuse to goe out of his owne ship whereupon the said Archer did<br />
ymediately power in two broad sides upon him besides small shott<br />
before ever the ''Stockholme'' made any resistance, But then hee<br />
saith the said Jallis verily conceaveing and believeing the said Archers<br />
ship to bee an Irishe man of warre hee did fire his gunnes att him<br />
againe and [sXX] beganne and continued a fight with him for<br />
5 or 6 howers space, in which fight the stearesman of<br />
the ''Stockholme'' was slaine and 5 or 6 (whereof the skipper was<br />
one) very much wounded And saith that after some continuance<br />
of the said fight the ship the ''Phonix'' arlate came into them and<br />
then the said Jallis presumed them both to bee States men of warre<br />
and soe submitted and yeilded unto them and by them was brought<br />
into Portsmouth where she now remaineth. All which hee knoweth<br />
to bee true hee this deponent being present abord the said ship during<br />
all the said fight and then and there sawe and heard all the premisses<br />
soe said had and done as is predeposed. And further hee<br />
cannot depose.
To the last article hee saith that What hee hath predeposed<br />
is true.

To the first Interrogatorie hee saith that hee hath noe part or share in the said<br />
ship the ''Stockholme'' or her ladeing save only in a parcell of Oranges<br />
and Lemmons and a small quantity of Oyle which was abord the said ship<br />
when she was seized All which were belonging<br />
to the company in generall and were and are since taken and plundred out of<br />
the said ship by the Company of the said Archers ship. And otherwise hee<br />
cannot depose.
To the second Interrogatorie hee saith and deposeth that when the said ship was<br />
seized there was only the two ships predeposed present And other wise<br />
referring himselfe to his foregoing deposition hee saith hee cannot<br />
depose saveing that in the said fight there was one of the Company of<br />
the said Archers ship slaine.
