Scilley was assaulted sett upon surprized and taken<br />
by two Jersey men of Warre and by them with her<br />
ladeing together with this deponent and company were<br />
carryed first into Scilley and afterwards into Jersey where<br />
the same was condemned for and made prize of<br />
And saith that the said shippe and ladeing was soe seized<br />
by Nicholas Hill and Nicholas Cloud[?e] Comanders of the shipps the<br />
''ffrancis'' and the ''Patricke'' of Jersey upon the first<br />
day of ffebruary last past old stile. The premisses<br />
hee deposeth hee this deponent being as aforesaid Master<br />
of and abord the said ship the ''Mathew and John'' when shee<br />
was seized and was with many of his company carryed<br />
into Jersey where hee and they were detayned<br />
Prisoners for diverse moneths together. And further hee<br />
cannot depose
To the 3d. Interrogatorie hee saith and deposeth that at the said tym of the surpri[?zall]<br />
of the said shipp the ''Mathew and John'' Edward Arlibeere the Elder<br />
John C[?o]per Richard [XXX] John Harris James Newman Mr Long<br />
George witham Alexander Eves William Salmon Thomas<br />
Fawson George Pasfeild and hee this deponent all Inhabitants<br />
in abd about London were the true and lawfull owners and<br />
Proprietors of the said ship and of her apparell and<br />
furniture And saith that at the said tymw<br />
the said Edward Arlibeare the Elder was owner<br />
of one 8th and one two and thirteth parts of the said shipp<br />
and the said John C[?ape] of one 16th and one 32th part and<br />
hee this deponent of three 16th parts of the said shipp the ''Mathew''<br />
''and John'' which hee knoweth to bee true because hee this deponent<br />
hath seene the bills of sale which the said Edward Arlibeere the<br />
Elder and John [?Cape] paid for theire said parts in the said ship and<br />
hath one himselfe for his owne share therein All which were<br />
made out by the said William Salmon who had the grand bill of<br />
sale of the said ship. And further hee cannot depose.
To the Crosse Interrogatories on the behalfe of Richard<br />
Shute and ffrancis Sayon assurers.

To the first Interrogatorie hee saith that the said ship the ''Mathew''<br />
''and John'' arrived at the Canaryes upon or about the 13 or<br />
14 day of december last old stile and came from thence for<br />
London upon the 9th day of [?ffebruarye] next following as<br />
hee hath predeposed to which hee referreth himslefe And<br />
further hee cannot depose.
