and hee had and received goods from thence , and saith that all the said shipps<br />
goods, saving the tobaccoes aforesaid belonging to this deponent, and a quantitie<br />
belonging to others of the shipps company and about elaven hogsheads belonging<br />
to a younge man dwelling in T[?orrieXe] were and are belonging to the said<br />
Bassili[?era] and company and not to any Inhabitant of Virginia or other<br />
person, which hee knoweth being merchant as aforesaid of the said shipp<br />
and knowing that the same were bought with their effects, and otherwise<br />
hee answereth negatively.
To the fourth hee saith that the said shipp the ''ffortuna'' carried in her to<br />
Virginia tenn guns or peeces of ordnance and noe more, and brought the same<br />
and noe more back againe, and left none at Virginia that were<br />
carried out in her.
To the fifth hee saith that neither at the time of the shipps arivall at<br />
Virginia nor at any other time after, did this deponent perceive, or heare<br />
that the Inhabitants there had set up them selves in opposition to or as distinct<br />
from this Commonwealth of England, and saith that there were noe<br />
passengers carried thither in the said shipp ''ffortuna'', and otherwise negatively
To the sixth article hee saith and deposeth that the said shipp the ''ffortunas''<br />
outward lading was not consigned to any in Virginia this deponent going<br />
merchant thereof as aforesaid, and having the disposing thereof in traffique<br />
to and for the accompt of the said producents.
To the last hee saith that there were no papers or writings aboard the said<br />
shipp at the time of her said seizure, save only this deponents booke or<br />
notes of the cargo, which hee beleeveth to be still in the said<br />
shipp, and saith there were noe papers or writings torne, throwne<br />
over board or otherwise concealed or made away.

To the first and second articles of the said allegation hee saith and deposeth that hee<br />
well knoweth the producent John Ba[?ssiliera], and that hee the said Bassiliera<br />
and company were the time arlate owners and lawfull proprietors of the shipp the<br />
''ffortuna'' arlate and of her tackle apparell and furniture and soe commonly<br />
accompted and reputed, And that in or about the moneth of September last<br />
the said Bassiliera and company sent out and imployed the said shipp the<br />
''ffortuna'' from the port of Middleborowe for Virginia on a trading voyage<br />
for their owne use and accompt, and to retourne thence againe for Middleborowe<br />
and further that the said shipp carried a Cargazon of goods from Middleborowe<br />
to be disposed of at Virginia and to bringe the retourne thereof in Tobaccoes<br />
for Middleborow[?a]. All which hee knoweth being the said voyage boatswaine<br />
of the said shipp. And otherwise hee cannot depose.

To the third and fourth articles of the said allegation hee saith and deposeth that<br />
the said shipp the ''ffortuna'' outwards bound arived at Virginia the said voyage<br />
on or about the 17th day of November (old stile) 1650 and not before, and<br />
then and there began to dispose of her outwards lading and to gather in<br />
debts which were there before remayning due to the producents for goods<br />
formerly carried thither from Middleborow[?a], and to receive in againe her<br />
homewards lading, And saith further that at and upon the said arivall<br />
there was at Virginia noe newes talke or tidings at all that the Parliament<br />
of England had forbidden or prohibited trade or traffique to or<br />
with the Inhabitants of Virginia whereas if there had bin any such talke or<br />
speech, hee beleeveth hee should have heard or had some intelligence thereof<br />
which hee saith hee did not. And otherwise hee cannot depose.
To the fifth and sixth articles hee saith and deposeth that the said shipp the ''ffortuna''<br />
after her arivall as aforesaid at Virginia fell to taking in and receiving her<br />
