Transcription whilst hee was abord and did divers times,whilst hee was abord and did divers times, without the licesnse or leave<br /> of the said Captaine Wye forsake and leave the said shipp and [?service] and goe on<br /> shore in Lisborne , and there did behave him self very unseemely and<br /> a[?ggressively], and att last deserted his imployment and ran away from<br /> the said Captaine Wye into the imediate service of Prince Rupert, and after<br /> =wards came aboard the said shipp the ''Saphire'' and tooke away his [XXXs]<br /> and returned againe to the service of the said Prince, And hee saith that when hee<br /> the said [?Ruberry] came to them in the said shipp [?hee] was under saile<br /> and hee might very well (if hee would) have come[?n] along with them but<br /> on the contrary did obstinately refuse to continue in his service<br /> under the said Captaine Wye, and went backe to Prince Rupert. All which this<br /> deponent saith hee knoweth for that he was on board the ''Saphire'' aforesaid<br /> and some times on shore att Lisbone when hee hath seene and observed the<br /> said Ruberry to [XXXX] [XXXX] himself as aforesaid And further hee knoweth not<br /> saveing hee saith that att the time of his imployment under the service of the said<br /> Captaine Wye, hee observed that the said Wye did very much [?treate] the<br /> good of the said Ruberry, and [XXX] [?ever] forward to further the [XXXX]<br /> of Merchants and others unto him the said Ruberry when they came aboard the<br /> said shipp to [ffXXX] or otherwise Repeated as before. '''Cornelius Cornelison''' of fflushing in Zealand Sailer,<br /> Cooke of the said shipp the ''Winter kinge'', aged<br /> 28 yeares or thereabouts sworne the say above said<br /> before the right Worshipfull William Clarke doctor of lawes<br /> one of the Judges of the high Court of the Admiraltie<br /> and examined upon Interrogatories ministred on the behalfe of<br /> the said [XXXX] Phillips and company saith as followeth,<br /> videlicet To the first Interrogatorie hee saith that hee well knoweth the shipp the<br /> ''Winter kinge'' interrogated and was one of her company being Cooke<br /> on board her at the time of her seizure interrogated, and tthat the said shipp belongeth<br /> to the port of fflushing and that belongeth to Peter<br /> [?Xelin?x] an Inhabitant and marchant of the said towne, well knowne<br /> unto this deponent. And otherwise hee cannot depose. To the second Interrogatorie hee saith that the last place from the which the said<br /> shipp came before her seizure by Captaine hurley was d[ooland] neere<br /> Quinperley in Bretany in the kingdome of ffrance laden with wheate and rice<br /> taken in and on board the said shipp at the said place of<br /> [?dooland] neare Quinperley, which wheate and rice were there brought on board by one C[XXXX] Breton and were to have bin carried and<br /> transported in the said shipp to fflushing in Zealand and there delivered<br /> (as the skipper Cornelius Johnson vander veld told him this deponent) to and for<br /> the use of the said shipps said owner, being dutch men and otherwise hee cannot<br /> answar or depose, saving hee giveth a reason of his knowledge of the place<br /> of lading the said goods because hee was aboard and sawe the same soe laden<br /> being one of the company as aforesaid of the said shipp. To the third hee saith hee cannot depose, saving hee doth not knowe of<br /> any papers or writings torne, burnt, throwne oover board or otherwise<br /> concealed To the fourth hee saith that the said shipp and lading were seized by Captaine<br /> hurley on the high and open seas about five leagues off [?Portland], betwixt<br /> that and the Ile of Wight, and not in any port or harbour.
