the tyme arlate videlicet in December last<br />
past hee this examinate and another man called John Huntman imployed and<br />
sent by his precontest John Hearne with the Lighter in question which Hearne<br />
had formerly hired of the arlate Baldene whoe was generally accounted<br />
reputed and taken to bee the owner of her to goe from St Catherines upp to<br />
Buttolphs Wharfe to the arlate shippe the ''Providence'' of which the arlate<br />
[?Willim] Backhouse was sayd to bee naster to fetch ballast out of the sayd<br />
shippe and accordingly hee this examinate and the sayd Hunt did carrye upp the<br />
sayd lighter to the sayd shippe to Buttolph Wharfe aforesaid where she then laye and [?XXXXX] and<br />
fastened the sayd Ligher to the sayd shippe with twoe ropes one belonginge<br />
to the Lighter and another which they had from the shippe they<br />
demannded the ballast of the masters mate of the sayd shippe<br />
and the rest of the Company then aboardthe master himselfe being absent the accordinge as they had order to doe but they in<br />
the shippe refused to doe as knoweinge that it did not belong to them soe soe doe and thereuppon<br />
those on the shippe or some of them told this examinate and his fellowe that if they would not heave in the said<br />
ballast they should not have any there and and told them lett it alone till it<br />
was cleere daye light sayeinge that then they would have aboard one<br />
shippe or other and sell the said ballast and thereupon this examinate<br />
and his fellowe aforesaid went away leavinge the lighter in question<br />
fastened to the shippe as aforesaid with her Companies consent to acquainte the aforesaid<br />
Hearne that sent them of the premisses but before they could meete with the<br />
said Hearne and hee speake with the Master of the said shippe the ''Providence''<br />
they heard that the sayd Lighter was suncke the shipps Company<br />
haveinge removed her from whence shee was by<br />
him and his fellowe fastened to the shippe and fastened her to another<br />
place which sinkinge was occasioned by theire heaveinge of ballast<br />
unadvisedlye into her in the absence of this examinate and his fellowe noe bodye being in her to looke to her and stowe<br />
the ballast in her as ought to have bine and this examinate and his<br />
fellowe had and would have don in case the shipps Company had not<br />
refused to heave the ballast out of the shippe as was desired then and the sayd<br />
Lighter was at the tyme when it was fastnened to the sayd shipp as<br />
aforesaid a thight stronge and staunch lighter and able to have<br />
carried in her above twentye tonnes of ballast if it had bine stowed<br />
in her as ought to have bine and by reason of the prenisses the<br />
sayd Lighter is broaken to peeces and never to bee recovered or made<br />
serviceable againe in soe much that the said Baldre hath suffered damage<br />
thereby above 20 ''li'' sterlinge . this hee sayeth is true by vertue of his<br />
