Ad primum arlum libelli in hac parte dat et oblat dicit et deponit<br />
That within the tyme arlate, the arlate John ffaireborne since deceased<br />
was master of the arlate shipp called the ''Elizabeth'' of London and had<br />
the [?compound] and disposinge of her in a voyage to be made with her<br />
from the porte of London to Virginia, and was accompted to be<br />
owner of an eighth part of the sayd shipp tackle and furniture The<br />
premisses he knoweth to be true for that he hath seene the Charter<br />
partye and the covenants and agreements made betwixte the sayd<br />
ffayreborne and his owners and merchants which fraighted and sent<br />
her forth on the sayd voyage wherein the sayd ffayreborne was<br />
written and acknowledged to be master, and owner of an eighth part of<br />
the sayd shipp tackle and furniture, Et alr nescit<br />
deponere saving he sayeth that the arlate William Hill was reputed<br />
to be masters mate or pilott of the sayd shipp the voyage aforesayd/.
Ad 2. 3. 4 et 5 arlos libelli dicit et deponit That in or about the<br />
moneth of September Anno domini 1637. last past the arlate John<br />
ffaireborne came to the arlate William Crosse the producent and<br />
in this deponents presence (dwellinge in the same yard where<br />
the sayd Crosse dwelleth) tould this deponent that some of his (the sayd<br />
ffayrebornes) ownerrs could not agree amongest themselves and would not or could not sett forth their parts of<br />
the sayd shipp on the sayd voyage and therfore he must be inforced<br />
to take moneys uppon bottomrye on the sayd shipp to victuall<br />
and sett her forth and desired the sayd Mr Crosse to Lende<br />
him fiftye pounds towards the victuallinge and setting forth of<br />
the sayd shipp on the sayd boyage, and the sayd ffaireborne and<br />
William Hill who then came with him did both promise to binde<br />
themselves and the sayd shipp tackle and<br />
