or agent for this rendent) wherein he<br />
did inclose a bill of ladeinge invoice<br />
and a letter directed unto one Lawrence<br />
de Novalls with whom this rendent never<br />
was acquainted nor ever had any dealings<br />
or comerce withall but onely used his<br />
name by the advice of his freinds<br />
aforesaid meerely for the preservation<br />
of his owne goods.
To the second pretensed position he anwereth<br />
and beleeveth, that the letter, Invoice and<br />
bill of ledeinge were and<br />
remained aboard the said shippe the<br />
''diamond'' att such time as she was<br />
seized uppon surprized and taken, by<br />
the arlate shipps, the ''Merchant Adventure''<br />
and the ''Peter'', and the said letter or<br />
invoice was and is written by the proper<br />
handwritinge of this respondent, and<br />
were inclosed in another letter remaininge<br />
in the registry of this Court directed unto<br />
the said John Richard an Englishman<br />
resident at Saint Maloes which this rendent<br />
did by the advice of one Mr hungerford of<br />
Exeter mrechant not knowinge, nor ever<br />
haveinge had any dealings or correspondence<br />
with the said Lawrence de Novalls, but this<br />
rendent did write the same meerelye<br />
colourably, and to avoid arrests in<br />
ffrannce, and for the preservation of his<br />
owne hoods, with which he went in the<br />
said shippe the ''dyamond'', and was on<br />
board the said shippe the ''dyamond'' att the<br />
time of the takeinge thereof, and that all the<br />
said goods claimed by this rendent in this<br />
