Transcription

by Mr Newland and Company by order of Captaine hurley for the
Constants company, Simon Baily the master and other of the mariners
thereunto consenting, and severall other moneys for [?corne] and otherwise
were received by the said hurley, but the quantitie hee knoweth not. And
otherwise hee cannot answer saving as aforesaid.

To the second hee saith that while the Ile of Wiering was unlading the said
Smith and others of the Constants company plundred and purloined severall
goods out of her, breaking up a baile of linnen and taking a greate part
thereof away of this deponents sight and knowledge, and saith that all the
amariners present were consenting and aiding therein./ And otherwise
hee cannot depose.

To the third hee saith that upon the taking of some of the fore said
prizes, the said Captaine Phillips in this deponents presence and hearing
asked the mariners whether they expected their thirds from him or not and
they answered noe, they would have nothing to doe with him, but with
Captaine hurley, and that they only looked on Captaine hurley for their
paymaster, and would not trust Captaine Phillips with their lives
or to the same effect. And otherwise saving as aforesaid hee cannot answer.

To the fourth hee saith hee verily beleeveth that the charges of the
Customes and otherwise of the said prizes, and the freight of the
Constant could not amount to lesse then two thousand pounds.

To the fifth hee saith the said marriners mentioned as aaforesaid longe before
the expiration of six monethes service in the Constant, and the said Captaine
Phillips ordered that the said 300 li paid by Mr Newland should be paid
them to the end they should goe and proceede againe to sea, and would
have he said Baily the master have gonne to London to receive it, but they
said noe, if it were paid to mr Searle according to Captaine hurleys
order, it should be sufficient, and they would proceede on their voyage,
And otherwise hee cannot depose saving as aforesaid.

To the sixth hee saith hee hath seene severall letters of attourney made by
severall of the Constants company for the receiving of their shares of severall
of the prizes of Captaine hurley, and such letters of attourney were made
shortly after the taking the said prizes. And otherwise hee cannot depose.
