Tanner did at his owne suite bring an action in this Court against the
plankes in question And to the rest of the Interrogatorie hee answereth negatively
To the second hee saith hee doth in the behalfe of this Commonwealth prosecute
this suite against the Interrogate Artys and the most of the parties in this suite and hath given instructions to Mr Budd
for drawing the allegation Interrogate, And to the rest of the sayd Interrogatorie
hee answereth negatively./
To the 3 hee saith hee hath knowne the Interrogated Adams for these 5 otr 6 yeares
last past, and the Interrogated Joseph Artys for these 2 or 3 yeares last past And
further hee cannot answere not knowing what to beleeve in the case Interrogate/
To the 4th hee saith the timber and plancks that hee this deponent bought as
aforesayd of the sayd Tanner Richardson and Adams for the use of this
Commonwealth, did part thereof, lye together betweene a hedge and a [?payle]
in Evesham Parke distinct from other planckes and tymber, and other part
thereof lay dispersed in other parts in the sayd parke and other grounds
neere thereto dispersed, And to the rest of the Interrogatorie hee
answereth negatively for that hee knoweth part of the plankes in quesion are and
were part of the plankes belonging to this Commonwealth by him
bought as aforesayd and further hee cannot answere/
To the 5th hee cannot answere knowing nothing
touching the contents thereof/
To the 6th hee cannot answere knowing nothing touching the reality of
the sayd bills of sale/

London Scrivener aged 54 yeares or thereabouts a wittnes
sworne and examined saith and deposeth as followeth videlicet
To the first second third and fowerth articles of the sayd libell and
to the writeing in parchment in the sayd 4th article mentioned and beginning
and ending as in the sayd articles is deduced hee saith that the arlate henry
Simpson in the moneth of december 1653 was then commonly reputed
the lawfull and sole Owner and Proprietor of the shipp the ffrancis of
Sunderland arlate
