Transcription

his comeing to Saint Lucar aforesaid in December last did see and observe that the
sayd ship or Catch the John and Elizabeth did then want a mayne maste and Rigging and
had only the Master and his Mate and a boy belonging to her, but hee this deponent verily
beleeveth that the Catch might have bin fitted and furnished there with all
men and all things necessarie, to have proceeded on her
voyage to Santa Cruze if the sayd Keene her Master had bin industrious
and had earnestly endeavoured to fit him selfe with men and necessaries
to proceede on the sayd voyage, and the reason why hee soe beleeveth is for
that hee heard the sayd Keenes Mate one Lansely saye that presently after the sayd Catch
her first arrival at Saint Lucar the sayd Keene was offered a very good mayne
mast and which as the sayd Mate sayd would very well have served to proceede on
the voyage to Santa Cruze , and further sayd that if the sayd Keene would
have trusted him the sayd Lansely with the mannagement thereof hee could
have fitted the sayd catch with all things necessarie to proceede on her voyage
to Santa Cruze and have procured men to have sayled her to Santa Cruze, but
sayd, the sayd Keene would not trust him the sayd Lansely with provideing
men and necessaries to proceede on the sayd voyage but had turned him the
sayd Lansely on shoare and told him that hee should have no further
entertainment in her or to that effect And for that hee alsoe saith that the sayd Lansely and others
did alsoe tell this deponent that one Mr duck (a correspondent of sayd Cowes at
Saint Lucar) did offer to supplye the sayd Keene with whatsoever money hee stood
neede of to fit him to proceede on his sayd voyage to Santa Cruz And also [?XX] to
the best of this deponents now remembrance the sayd Mr duck alsoe
told this deponent that hee had offered the sayd Keene to supply him with such money
as hee wanted, and was fit, to furnish him to proceede on his sayd voyage to
Santa Cruze and further to this article hee cannot depose/

To the 6th hee saith hee this deponent knoweth that the sayd Keene
did let his sayd vessel or catch the John and Elizabeth to freight at Saint
Lucar to one Mr William Bland Merchant to bringe goods to London
and did accordingly take the sayd Blands goods or the greatest part of them
on board his sayd vessel while this deponent stayed at Saint Lucar, And hee
this deponent for his part verily beleeveth and is perswaded in his conscience that the sayd Keene might if hee had
pleased as well, and as easily have gone on his voyage to Santa Cruz as
have come with the sayd goods for London, And further hee cannot depose

To the 7th and 8th articles hee cannot depose./

To the 9th hee saith hee referreth himself to the Registry of the
Admiralty Court And further cannot depose

To the last hee saith his foregoeing deposition is true/

To the first hee saith hee cometh to testifie the truth of his knowledge in
this cause being soe requested to doe by the producent Mr Cowse to whom
hee is nothing of kinn nor any servant to him, and saith hee hath noe
share or interest in this cause, and favoureth both parties litigant a like, and
shall receave neither benefit nor preiudice or losse which paartie soe ever
prevaile in this suite, nor expecteth or hath received any reward for him selfe
in this cause./
