Transcription

To the fifth article he deposeth that he hath heard and doth
beleive that the articulate John Edge hath acknowledged under
his hand the receiving of the said goods and materialls for the
use of the said shipp. But otherwise he cannot depose, saving
he referreth himselfe to his former deposition./

To the sixth and seaventh articles he saith that the want of the
said summe of 50 li 9 s 3 d hath bin (in this this deponents
knowledge) at least five pounds out of the Producents
way in buying bargains, since the money was due, And he
alsoe saith that the said producent hath lost much time in
demanding the said money, and running after it And
further he cannot depose./

To the eight article he saith that the producent having noe other
helpe hath arrested the interrate shipp the Releife, And further
he deposeth not referring himselfe to the Registry of this Court

To the ninth he saith that the arlate Edge is a member of this
commonwealth and subiect to the Jurisdiction of this Court.

To the tenth he referreth himselfe to the Law.

To the last he saith his former deposition is true.

John Cheshire of Rederith in the County of
Surry Nailor, aged 28 yeares and upwards,
a wittnes produced, sworne and examined he deposeth
and saith as followeth

To the first article of the sayd Libell he deposeth that he this
deponent did in the months of January, ffebruary and March
last past worke in the shopp of Nicholas Carter the
producent as his Nailor, and that in the said monthes
the shipp the Releife arlate lay in a Dock neere the said
Carters house, wherby and for which reason he well knew
the said shipp, and that the arlate John Edge was in the
said months the Master of her, and had the care and command
of her, The which he well knew for that the said Edge
did come to the said producents shopp and there gave order in
this deponents hearing that whatsoever iron=worke or goods
that any of the sayd shipps Company (which were knowne to any of the
shopp) should come for that they showld be delivered And
further to this article he cannot depose.

To the second and third articles of the sayd Libell and to the schedule
therin mentioned and now at the time of his examination being read
over unto him he the deponent saith That all the severall goods
materialls and provisions mentioned and particularized in the
said schedule, were the proper goods of the sayd producent, and
that the same were delivered out of the said producents shopp
to such of the said shipps Company as came for them by the
direction of the arlate Edge (as he beleiveth) for the said
shipps use, The premisses he knoweth being present and at worke
in the said shopp when the said materialls and provisions
were come for and delivered out, And further to the said
articles and schedule he cannot depose./
