Transcription

To the second Article hee saith, That in or about the moneth of July 1653
last past the shipp the Margarett and Elizabeth arlate under the Commannd of
this deponent and Companie did meet with and surprize at sea a certaine dutch
shipp called the pyd Cowe of Rotterdam laden with salt, which shipp and ladeing
they afterwards brought to Newfoundland, and there by reason of the perishablenesse
of that commoditie, this deponent caused the same to bee unladed and putt the
same into the possession of George hopkins the partie querelate in this suite
to whom this deponent caused 18 li sterling to bee paid for the same unlading
and the said hopkins provided Warehouses to receive the same, and for
his soe doeing this deponent contracted and agreed to allow the said hopkins
three hogsheads out of every twenty hogsheads, whereupon the said hopkins permissed
and undertooke to this deponent to deliver back upon demmannd 17:
hogsheads of salt for every score of hogsheads soe received to the use and benefit
of the said William Bennet and Companie as by an Instrument of Agreement bearing
date the 26th of August 1653. and beginning A Covenant and
agreement remaining in this Court, and signed and sealed by the said
hopkins and this deponent doeth and may amongst other things appeare
And further hee cannot depose:-/

To the 3d hee saith, hee this deponents satisfaction to the contents of this
article referreth himselfe to the said Contract Covenant or agreement
the Contents whereof hee declareth to bee reall and true, And soe
had and done as therein is conteyned. Annd further cannot depose:-/

To the fourth hee saith, That upon or presently after the said Agreement
the said George hopkins tooke possession of the said ship at Newfound
land in order to her bringing home from thence to Plymouth in
pursuance of the said Agreement this deponent being the person who did
deliver him possession thereof, but as in the rest of the said position hee
saith hee knoweth nothing thereof:/

To the fifth hee saith, That the usuall price of goods transported from
Newfoundland to Plymouth was and is 3 li a tunne soe farr as
this deponent ever heard or observed, And further hee cannot depose:-/

To the 6th hee saith, That the salt aforesaid delivered out of the Pyed
Cowe to the said hopkins consisted of sixe hundred sixty and eight
hogsheads or thereabouts out of which hee was to have for the keeping and warehouse
roome three hogsheads of salt, and the rest hee was to make good and redeliver
to the said William Bonnet and Companie or their order, as this deponent agreed with him
The premisses hee knoweth upon the grounds formerly expressed. And
further cannot depose:-/

To the 7th hee saith, That a hogshead of salt was and is usually worth
twenty shillings at Newfoundland, and for soe much this deponent hath
sold the same. And further to this article hee cannnot depose:/

To the 8th hee saith hee knoweth nothing thereof:-

To the 9th hee saith hee referreth himselfe to the Acts and proceedings of
this Court:-/
