hee saith hee well knoweth, for that hee was and is the arlate
ferdinando hespell who contracted with the said producent for the said
shipp and wynes upon the Conditions predeposed. And further hee
cannot depose:-/

To the 7th hee saith hee referreth himsele to the Registry and proceedings of
this Court, And further cannot depose:-/

To the 8th hee saith, That after the said sale made by the producent of the
shipp and wynes predeposed, the said shipp and goods were for severa;;
moneths detained at Portsmouth by the Officers of the Custome there
whereupon as this deponent was credibly informed, the said Captaine Phillips
did protest against them, and this deponent seeing the wind had been faire
and favourable for the bringing about of the said shipp and goods from
Southampton to London according to the Contract aforesaid, and perceiving
that other shipps had come from those parts within that time, did also
protest against the said Captaine Philips for non-performance of
Contract. And further hee cannot depose./

To the 9th hee saith, hee verily beleeveth the said shipp and lading might
in all probability have beene here at London within the time by the
said Contract predixed, if shee had not been staied and hindred as
aforesaid. And further hee cannot depose:-/

To the 10th hee saith, That the said shipp the Saint Paul and her lading
did not arrive in the river of London till about the 7th or 8th of
Aprill 1654. being long after the time by the said Contract concluded
upon, and that within that time many wines arrived here, whereby
the Prizes of wines were very much abated so that this deponent
persisting by his said Contract as to the punctuality of the time
limited and prescribed therein, did refuse to accept the said shipp and
lading upon the said Contract, All which hee saith, so farr as this
deponent could ever be informed was occasioned by the said Commanders detention
of the said shipp and goods. And further cannot depose./.

To the 11th hee saith, That after the said shipp and goods arrived at
London, the wynes were by the producents order disposed of into
Sellers and warehouses, which were afterwards secured and locked
up by order of the Commissioner for Prize goods, as this deponent was
credibly informed, where they remained under that restraint for
about two moneths as this deponent saw and observed And
further hee cannot depose.

To the 12th hee saith, That the said wynes by such their detention and
restaint were exceedingly much deteriorated and spoyled, insomuch that
the most part thereof was not worth half the Customes required
for the same, and the charges for them expended, so that in this
